Mayor Mori declared the public hearing closed. After discussion, it was moved by Councilwoman LeClaire, and seconded by Councilman Herlihy, that Resolution No. 74-238, denying the appeal of Ad-Art, Inc., from an ad- verse decision of the Board of Adjustment for a Variance request from Bank of America from the requirements of Section 2-9o43(a), Article 18, Chapter 2, Title II of the Ordinance Code of the City of Pleasanton, to allow the construction of a freestanding sign on a parcel located in the C-N (Commercial Neighborhood) District, which is less than 3 acres in size, be adopted. The roll call vote was as follows: AYES: Councilman Herlihy, Councilwoman LeClaire, Councilman Philcox, and Mayor Mori NOES: None ABSENT: Councilman Kinney Mayor Mori recessed the meeting at 9:45 P.M. Mr. Scheidig discussed the legal steps required to sell this property. It was moved by Councilman Philcox, and seconded by Councilwoman LeClaire, that Resolution No. 74-239, declaring City property in the Peters Avenue Parking Local Improvement District No. 74-10 as surplus and authorizing the City Attorney to prepare the necessary documents to sell this property to the adjacent owner, Cit ' Mike Stanley, at a price of $4.25 per square foot, less the y s present $3,713e00 P~urki~gAssessment for this parcel, be adopted. Gerton for an Exemption from the Restricted Growth Policy for three (3) lots on Kottinger Drive Mro Edgar stated the Restricted Growth Policy had been formulated by the City Council as an outgrowth of problems due to sewer capacity. Mr. Sooby presented the staff report dated December 5, 1974, regarding this matter. Mr. Mark Gerton, 1192 Rotringer, representing Mr. and Mrs. William Ackerman, requested exemption from the Restricted Growth Policy for a parcel of 2.37 acres south of Kottinger Drive, because of economic hardship. Council expressed sympathy to the property owners but stated the Restricted Growth Policy must be adhered to. Mayor Mori stated the real problem was the taxing system. 4. 12/9/74
