11 <br /> <br /> It was moved by Councilwoman LeClaire, and seconded by Councilman Herlihy, that <br />Resolution No. 74-148, retaining MacKay and Somps, Civil Engineers, to complete the <br />engineering work on the proposed Downtown Parking District, at an approximate cost <br />of $8,000.00, be adopted. <br />The roll call vote was as follows: <br />AYES: Councilman Herlihy, Councilwoman LeClaire, Councilman Philcox, and <br /> Mayor Mori <br />NOES: None <br />ABSENT: Councilman Kinney <br /> <br />Report~ Re: Amicus Curae Participation - Fair Labor Standards Act <br /> Mr, Scheidig advised the Council that the State of California and other States <br />were contesting the constitutionality of the F.L.S~A. The National League of Cities <br />is retaining counsel for an amicus brief supporting this litigation. The pro-rata <br />share of the cost for Pleasanton, if it participated would be $200°00. Staff re- <br />commended participation by the City~ <br /> <br /> It was moved by Councilman Herlihy, and seconded by Councilman Philcox, to <br />support the filing of an amicus curae brief in litigation contesting the validity <br />of the Fair Labor Standards Act as it applies to the State and Cities, and auth- <br />orizing the sum of $200.00 to be paid in support of said brief. <br />The roll call vote was as follows: <br />AYES: Councilman Herlihy, Councilwoman LeClaire, Councilman Philcox, and <br /> Mayor Mori <br />NOES: None <br />ABSENT: Councilman Kinney <br /> <br />Legislation <br /> Mr. Scheidig presented his report regarding SB-2450 - ADA payments to community <br />colleges for police-fire courses. <br /> <br /> It was moved by Councilman Philcox, and seconded by Councilwoman LeClaire, that <br />the City Council go on record in support of SB-2450, and authorizing the City Attor- <br />ney to advise the appropriate legislators of this. <br />The roll call vote was as follows: <br />AYES: Councilman Herlihy, Councilwoman LeClaire, Councilman Philcox, and <br /> Mayor Mori <br />NOES: None <br />ABSENT: Councilman Kinney <br /> <br />COMMUNICATIONS <br /> There were no Communications presented at this meeting. <br /> <br />CITY COUNCIL COMMITTEE REPORTS <br /> There were no City Council Committee Reports presented at this meeting. <br /> <br />MATTERS INITIATED BY COUNCIL MEMBERS <br /> There were no matters initiated by Council Members at this meeting. <br /> <br />ADJOURNMENT <br /> Mayor Mori adjourned the Regular Meeting at 10:45 P.M., to meet again in <br />Executive Session on Tuesday, July 9, 1974, at 5:00 P~M., in the Pleasanton <br />Justice Court, 30 West Angela Street. <br /> <br />Respectfully Submitted, <br /> <br />WILLIAM H.
