349 <br /> <br /> Mayer Kinney recessed the meeting at 10:50 P.M. <br /> <br /> Mayor Kinney reconvened the meeting at 11:00 P.M. <br /> <br />MATTERS CONTINUED FOR DECISION <br />Application of the Planning Commission from Pleasanton Garbage Service to prezone <br />approximately 23 acres of land located at 2512 Vineyard Avenue from A (Agricultural <br />as defined by the Zoning Code of the County of Alameda) District to A (Agricultural <br />as defined by the Ordinance Code of the City of Pleasanton) District (Continued <br />ppen from 1-27-75~ 2-10-75~ and 3-10-75) <br /> Mayor Kinney declared this item be dismissed from the agenda due to the resolution <br />of the previous item. <br /> <br />SPECIAL REPORTS <br />Presentation by. Dro James Gaeckle regarding Malpractice Insurance and request for <br />approval of SB-491 and SB-398 <br /> Dr. Gaeckle made a presentation regarding malpractice insurance and requested <br />Council support of SB-491, SB-398, and SB-674, He also requested support of the <br />following changes in the present system: (1) Increase the disciplinary authority <br />of the Board of Medical Examiners to eliminate incompetent physicians; (2) Change <br />the statute of limitation to 2 years after injury; (3) Regulate contingency fees <br />for attorneys to realistic levels as has been done in New Jersey; (4) Develop a <br />system of contracted binding arbitration that will remove medical liability claims <br />from the court jury system, so that most of any award will go to the injured patient <br />and not for legal and court costs; (5) Set Legislative limits on the size of awards; <br />(6) Re-define medical liability and ~egligence; (7) Allow the admission to the court <br />of all evidence; and (8) Repayment of the patient's claim should be made on a month <br />to menth basis rather than a lump sum. <br /> <br /> Council concurred to support SB-491, SB-398, and SB-674, and to communicate <br />this to the appropriate Legislators. council agreed to discuss Dr. Gaeckle's <br />eight point recommendations at a later date. <br /> <br />Approval of Revised Traffic Signal Priorities <br /> Mro Edgar presented the staff report dated April 3, 1975, regarding this matter. <br /> <br /> It was moved by Councilman Philcox, and seconded by Councilman McLain, that <br />Resolution No. 75-82, approving the revised list of traffic signal priorities as <br />listed in the report of the Director of Engineering Services dated April 3, 1975, <br />be adopted. <br />The roll call vote was as follows: <br />AYES: Councilmembers Herlihy, LeClaire, McLain, Philcox, and Mayor Kinney <br />NOES: None <br />ABSENT: None <br /> <br />Request irom Police Association to hang Banner on Main Street <br />Mro Edgar presented request from the Police Association to hang their Policeman <br />Ball banner under the overhead City of Pleasanton neon sign on Main Street from <br />April 15 through 19, 1975. <br /> <br /> It was moved by Councilman Herlihy, and seconded by Councilman Philcox, to <br />approve the request of the Police Association to hang banner under the overhead <br />City of Pleasanton sign on Main Street from April 15-19, 1975, subject to condi- <br />tions as required by the City. <br />The roll call vote was as follows: <br />AYES: Councilmembers Herlihy, LeClaire, McLain, and Philcox <br />NOES: Mayor Kinney <br />ABSENT: None <br /> <br />MEETING OPEN TO THE PUBLIC <br /> No one addressed the Chair <br /> <br />REPORTS OF BOARDS AND COMMISSIONS <br />Report of the Park and Recreation Commission, Re: Regulation of Amador High School <br />Tennis Courts <br /> <br /> Mr!l Caporusso presented the staff report dated April 7, 1975, regarding this <br />matter <br /> <br /> 5. 4/14/75 <br /> <br /> <br />
