Open from 12-16-74 and 2-24-75) <br /> Mayor Kinney declared this item continued to the meeting of April 28, 1975, <br />8:00 P.M., Pleasanton Justice Court. <br /> <br />SPECIAL REPORTS <br />Report, Re: Appeal of Hart & Ice from Notice of Intent to file Environmental <br />Impact Report~ Conditional Use Permit 75-2 <br /> Mayor Kinney declared this item dismissed from the agenda at the request of <br />the applicant° <br /> <br />Report, Re: Appeal of Dr. Ho LonS from the actions of the Planning Commission <br />denyinS Tentative Tract Map 3256 <br /> Mr. Scheidig presented the staff report dated March 6, 1975, regarding this <br />matter, and displayed map showing the area in question. He explained grounds <br />for denial by the Planning Commission of Tentative Tract Map 3256 as being that <br />the Map does not comply with City Ordinances, and the proposed improvements <br />will cause snbstantial environmental damage. Mr. Scheidig stated that the Map <br />as proposed would violate Section 66473 of the Government Code since the proposed <br />lots did not front on a public street as required by the City's Ordinance Code. <br />In addition, he noted that a final Environmental Impact Report had not been <br />prepared due to failure of the developer to grant an extension of the 50 day <br />time period within which a Subdivision Map must be approved. Thus, based on <br />information contained in the draft Environmental Impact Report, the Director <br />of Housing and Community Development's decision that the project would have a <br />significant effect upon the environment and the lack of a final Environmental <br />Impact Report, the Tentative Tract Map was denied by the Planning Commission <br />based on Government Code Section 66474(e). <br /> <br /> Mr. Gilbert Maines, Attorney representing Dr. Howard Long, the developer, <br />presented background information regarding this application, and requested that <br />the action of the Planning Commission be overruled and the new proposed Tenta- <br />tive Tract Maps be approved. <br /> <br /> After further discussion o'n the staff report and Mr. Mainesv comments, it <br />was moved by Councilman Herlihy, and seconded by Councilwoman LeClaire, that <br />Resolution Noo 75-54, 'denying the appeal of Dr. Howard Long from the actions <br />of the Planning Commission denying Tentative Tract Map 3256, be adopted. <br />The roll call vote was as follows: <br />AYES: Councilman Herlihy, Councilwoman LeClaire, Councilman Philcox, and <br /> Mayor Kinney <br />NOES: None <br />ABSENT: None <br /> <br /> Mayor Kinney recessed the meeting at 10:00 P.M. <br /> <br /> Mayor Kinney reconvened the meeting at 10:10 P.M. <br /> <br />MEETING OPEN TO THE PUBLIC <br /> No one addressed the Chair. <br /> <br />REPORTS OF BOARDS AND COMMISSIONS <br /> There were no reports of Boards and Commissions presented at this meeting. <br /> <br />REPORTS OF THE CITY MANAGER <br />Report~ Re: Annexation No. 69 <br /> Mr. Bowling presented the staff report dated March 6, 1975, regarding this <br />mattez, and displayed map showing area to be annexed. <br /> <br /> It was moved by Councilman Philcox, and seconded by Councilwoman LeClaire, <br />that the staff be authorized to file Annexation No. 69, 3.06 acres on Stanley <br />Boulevard, with the Local Agency Formation Commission. <br /> <br /> 5. 3/10/75 <br /> <br /> <br />
