It was moved by Councilmember LeClaire, and seconded by Council- <br /> member Herlihy, that the claims for damages and damages from inverse <br /> condemnation against the City of Pleasanton by Carl J. Graffenstatte, Jr. <br /> and by Graffenstatte Corporation dga Grafco Stations, be denied and <br /> referred to the City Attorney's office for handling and for defense, <br /> be approved. <br /> The roll call vote was as follows: <br /> AYES: Councilmembers Herlihy, LeClaire, McLain, Philcox and <br /> Mayor Kinney <br /> NOES: None <br /> ABSENT: None <br /> <br /> Oral Report; Re: Chan~es in the 1976 Elections Code <br /> Mr. Scheidig reported on Section 10012 amending the Elections <br /> Code and inquired of the Council if they (1) wish to increase the <br /> amount of wordage allowed summarizing a candidate 's background and <br /> qualifications included in the ballot pamphlets mailed by the County; <br />(2) does the Council wish to pro rate the mailing costs for candidates; <br />and (3) does the Council wish to allow any additional information to <br />be transmitted with the sample ballots regarding candidates. <br /> <br /> The Council agreed that 200 words would be sufficient for the <br /> candidate 's description and did not wish to increase the wordage <br /> to 400. <br /> <br /> Councilmember McLain felt that the County should give some assur- <br />ance that the sample ballots will be mailed to every voter in the City. <br />During the last election, it was his understanding that/250 sample <br />ballots were not received. at least <br /> <br /> It was moved by Councilmember McLain, and seconded by Council- <br />member LeClaire, that Resolution No. 75-254, approving the pro-ration <br />of City Council candidate's mailing costs for ballot information, <br />limiting the qualification statement to 200 words and not allowing <br />additional candidate information in sample ballot mailings, be adopted. <br />The roll call vote was as follows: <br />AYES: CounCilmembers Herlihy, LeClaire, McLain, Philcox and <br /> Mayor Kinney <br />NOES: None <br />ABSENT: None <br /> <br /> Mr. Scheidig further explained that the arrangements of names on <br />the ballot will be determined by the State by the drawing of the letters <br />of the alphabet by lot. Also, nomination papers will be available for <br />circulation December 4th and the deadline for filing is December 24th <br />at 5:00 P.M.; however if one of the:incumbents doesI not run, the nom- <br />ination period will be extended to December 30th at Noon. <br /> <br />COMMUNICATIONS <br /> There were no communications presented at this meeting. <br /> <br />CITY COUNCIL COMMITTEE REPORTS <br /> Councilmember LeClaire reported on her attendance at the Corps of <br />Engineers Water Basin Study organizational meeting and the League Con- <br />ference of Municipal Government in Los Angeles last week. She asked <br />the Council for an alternate for her to the ACAP Governing Board. <br /> <br /> Councilmember Herlihy reported on his attendance at the League <br />meeting last week and suggested that fellow Councilmembers check with <br />Mr. Edgar for available committees on which they would like to serve. <br />Also, State land planning will concentrate almost exclusively on <br />coastal land planning next year. <br /> <br /> Councilmember Herlihy also mentioned that he talked to Howard <br />Goode of BART regarding the establishment of feeder bus service to <br />Chabot College, Valley Extension.
