Mayo= Kinney declaced the public hearing open. <br /> <br /> Mr. Jo T. Woods, of Air-Vent Aluminum Company, on behalf of Salvador Victoris, <br />stated that due to the irregular shape and size of the lot he felt this was not an <br />undue encroachment, and also the screening allowed for an open area. <br /> <br /> Mr. Salvador Victoria, applicant, 3865 Hot Springs Court, stated the space would <br />be used as a recreation area and that his neighbors were not opposed to it. <br /> <br /> Mr. Bill Marshall, 3839 Hot Springs Court, stated his property was adjacent to <br />Mr~ Victoria and that he was not opposed to this construction and urged Council to <br />grant the Variance~ <br /> <br /> Mrs. Salvador Victoria, 3865 Hot Springs Court, explained the use of the room <br />and asked Council for ways to comply with the Ordinance and still have an adequate <br />recreation area. <br /> <br /> Council explained that they could not make the necessary findings for granting <br />a Variance and were disposed toward supporting the Planning Commission action, and <br />suggested an alteration on size of the room in order to comply with the Ordinance. <br /> <br /> Mayor Kinney declared the public hearing closed° <br /> <br /> After discussion, it was moved by Councilmember LeClaire~ and seconded by <br />Councilmember Herlihy, that Resolution No. 75-231, denying the appeal of Air-Vent <br />Aluminum Awning Company on behal£ of Salvador Victoria from an adverse decision <br />of the Board of Adjustment in denying an application for a Variance to Section <br />2-5.35, Article 3, Chapter 2, Title II of the Ordinance Code of the City of <br />Pleasanton, to allow construction of a screened patio cover at 3865 Hot Springs <br />Court, which would encroach into the required rear yard of the property; zoning <br />for the property is R-1-6500, be adopted. <br />The roll call vote was as follows: <br />AYES: Councilmembers Herlihy, LeClaire, McLain, Philcox, and Mayor Kinney <br />NOES: None <br />ABSENT: None <br /> <br />MATTERS CONTINUED FOR DECISION <br />Further discussion Re: 1-580 Support <br /> Mr. Scheidig presented a proposed resolution regarding this matter. <br /> <br /> Council suggested some changes to the resolution relating to further staff <br />action.
