He explained that the structure was built in 1971 when he was <br /> not aware of restrictions. Mr. Strand expressed concern that moving the <br /> structure would create physical and economic hardship. <br /> <br /> Mr. Edward J. Kulink, 1211 Ridgewood Road, Mr. Strand's next door <br /> neighbor, spoke in favor of this application. His yard is nex~ to <br /> the side of Mr. Strand's yard where the structure is located and had <br /> no objections to the accessory building and felt removal would affect <br /> the privacy of both patios. He stated both families moved in when the <br /> residences were new. <br /> <br /> As no one else wished to speak', Mayor Kinney declared the public <br /> · hearing closed. <br /> <br /> After discussion, which determined that there were no extraordinary <br /> or unusual circumstances on the property which would justify the granting <br /> of this variance, ',it was moved by Councilmember LeClaire, and seconded by <br />"' Councilmember Philcox, that Resolution No. 75-207 denying the appeal of <br /> the decision of the Board of Adjustment denying application for a variance <br /> from Section 2-5.35., of Article 3, Chapter 2, Title II of the Ordinance <br /> Code of the City of Pleasanton, to retain an accessory building which <br /> encroaches into the required side yard and is located too close to the <br /> main structure on the property, be adopted. <br /> The roll call vote was as follows: <br /> AYES: Councilmembers Herlihy, LeClaire, and Philcox <br /> NOES: Mayor Kinney <br /> ABSENT: Councilmember McLain <br /> <br /> Appeal of Grafco Petroleum from a decision of the Planning Commission <br /> to deny an application for a conditional use permit to allow the expan- <br /> sion of an existing service station located at 707 Main Street~ zoning <br /> for the prop.erty being C-C (Central Commercial') District <br /> Mr. Edgar read a letter into the record from Warren Annis in oppo- <br /> sition to the proposal. <br /> <br /> Mr. Harris presented this report and extensive background regarding <br /> the circumstances pertaining to this application. Mr. Harris stated <br /> that the staff feels that the present plan is workable and aesthetically <br /> more pleasing. The Planning Commission denial was based primarily on <br /> the fact that the Commission was not convinced the traffic situation <br /> would be alleviated and, secondly, that a gas station aesthetically <br />.... is not comparable with what has been done in the downtown. <br /> <br /> Mr. Harris and Mr. Edgar answered several questions from the <br /> Council. Mr. Edgar explained that the applicant submitted this plan, <br /> the staff reviewed it and attached several conditions, but it was denied <br /> by the Planning Commission. <br /> <br /> Mayor Kinney declared the public hearing open. <br /> <br /> -4- 9/22/75 <br /> <br /> <br />
