Mr. James Woods, 740 Dutton Ave., San Leandro, representing Air Vent Aluminum Awning Co. and Mr. Strand, spoke for the application and ap peal. Mr. Eric Strand, 1225 Ridgewood Road, passed drawing, photo and petition from neighbors in support of his application, among the Council- members. He explained that the structure was built in 1971 when he was not aware of restrictions. Mr. Strand expressed concern that moving the structure would create physical and economic hardship. Mr. Edward J. Kulink, 1211 Ridgewood Road, Mr. Strand's next door neighbor, spoke in favor of this application. His yard is nex~ to the side of Mr. Strand's yard where the structure is located and had no objections to the accessory building and felt removal would affect the privacy of both patios. He stated both families moved in when the residences were new. As no one else wished to speak', Mayor Kinney declared the public · hearing closed. After discussion, which determined that there were no extraordinary or unusual circumstances on the property which would justify the granting of this variance, ',it was moved by Councilmember LeClaire, and seconded by "' Councilmember Philcox, that Resolution No. 75-207 denying the appeal of the decision of the Board of Adjustment denying application for a variance from Section 2-5.35., of Article 3, Chapter 2, Title II of the Ordinance Code of the City of Pleasanton, to retain an accessory building which encroaches into the required side yard and is located too close to the main structure on the property, be adopted. The roll call vote was as follows: AYES: Councilmembers Herlihy, LeClaire, and Philcox NOES: Mayor Kinney ABSENT: Councilmember McLain Appeal of Grafco Petroleum from a decision of the Planning Commission to deny an application for a conditional use permit to allow the expan- sion of an existing service station located at 707 Main Street~ zoning for the prop.erty being C-C (Central Commercial') District Mr. Edgar read a letter into the record from Warren Annis in oppo- sition to the proposal. Mr. Harris presented this report and extensive background regarding the circumstances pertaining to this application. Mr. Harris stated that the staff feels that the present plan is workable and aesthetically more pleasing. The Planning Commission denial was based primarily on the fact that the Commission was not convinced the traffic situation would be alleviated and, secondly, that a gas station aesthetically .... is not comparable with what has been done in the downtown. Mr. Harris and Mr. Edgar answered several questions from the Council. Mr. Edgar explained that the applicant submitted this plan, the staff reviewed it and attached several conditions, but it was denied by the Planning Commission.
