REPORTS OF THE CITY ATTORNEY <br />Authorization to Negotiate for acquisition of pr0pe~t7 for the Extension of <br />Peters Avenue <br /> Mr~ Scheidig advised Council that acquisition of the property at 287 Rose <br />Avenue was necessary for extending Peters Avenue. The project is funded by <br />Housing and Community Development Program funds and HUD guidelines for acquisi- <br />tion must be followed. The City wishes to commence negotiations but must first <br />make an offer of the fair market value to the owner. Since the appraisal report <br />placed the fair market value at $58,000.00, authorization to make the request <br />was desired. <br /> <br /> Council inquired as to the impact on tenants and the results of relocation <br />assistance. <br /> <br /> After discussion, it was moved by Councilmember LeClaire, and seconded by <br />Councilmember Brandes, that Resolution No. 76-133, authorizing the City Attorney <br />to offer to the Roman Catholic Church the sum 6f$58,000.00 as the fair market <br />value for the property located at 287 Rose Avenue, be adopted. <br />The roll call vote was as follows: <br />AYES: Councilmembers Brandes, LeClaire, Mercer, and Mayor Philcox <br />NOES: Councilmember Herlihy <br />ABSENT: None <br /> <br />EXECUTIVE SESSION <br /> Mayor Philcox recessed the meeting to an Executive Session at 9:40 P.M., to <br />discuss the status of Graffenstatte vs~ City of Pleasanton and potential for <br />settlement of the litigation. <br /> <br /> Mayor Philcox reconvened the Executive Session at 10:00 P.M. <br /> <br />ADJOURNMENT <br /> There being no further business at 10:05 P.M., Mayor Philcox adjourned the <br />meeting to meet again in Regular Session at 8:00 P.M., on June 14, 1976, at the <br />Pleasanton Council Chambers, 30 West Angela Street. <br /> <br />Respectfully Submitted, <br /> <br />WILLIAM Ha AR, C~ CLERK <br /> <br /> 3. 6~3~76 <br /> <br /> <br />
