Mro Jamieson addressed the City Council thanking them for their confidence in <br /> him and assuring them of his beet efforts on behalf of the City Council, Planning <br /> Commission, and people of the community~ <br /> <br />PUBLIC HEARINGS <br />Application of Willow We~.nc~. tc fezone approximately 354 acres located between <br />Hopyard Road and the Southern Pacific ri ht-of~wa7 opposite the intersection of <br />Stoneridg~ Drive and Hopyard Road (~~s Parcel Numbers 941-700-1-11 and <br />946-2115-1-12), present zce~n~g._c~onfigura~t~ion of Industrial Parks ~eneral Indus- <br />t[ia~, Office, Service Commercial FreewalCommercial and piedominantly Agriculture, <br />would be changed.to pre~ominant!y 9en~ral Industrial, as well as, Industri.a!...parks.. <br />Light Industrial~ Office~ Commercial FrOewe7 and Planned Unit Development <br /> Mro Harris presented his report dated May 4, 1976, regarding this matter. <br /> <br /> Mayor Philcox declared the public hearing open. <br /> <br /> Mr. Dick Kern, 2551 Merced Street, San Leandro, representing Willow-West Pro- <br />perties, requested app=oval of the application with the 12 acre 'Office' zoning <br />remaining, as approved by City Council previously, instead of being placed in a <br />Study District or PUD~ He answered questions and addressed solutions to the various <br />concerns of the Council regarding traffic, noise, flood control, and sewer. <br /> <br /> Mr. John DiMauto, 300 South First Street, San Jose, representing Willow-West <br />Properties, Inc., answered Council questions regarding potential development of <br />the property. <br /> <br /> With r'egard to sewer capacity, Mayor Philcox requested that it be placed in <br />the record that Mr. DiMante and Willow-West Properties, Inc., were aware that sewer <br />capacity could not be guaranteed with the approval of the application for rezoning <br />of the property in question~ Mayor Philcox also asked if Willow-West was aware of <br />the Growth Management. Plan~ <br /> <br /> Mr. DiMauto stated he was not aware of the Growth Management Plan, but was <br />cognizant of the fact that sewer capacity was not available. He also indicated <br />that Willow-West was aware that its property was located in the service boundaries <br />of the V.C~S~D. Plant and due to the lack of any listing of said properties on the <br />priority schedule established by the 1972 Settlement Agreement would not be served <br />by a public sewage treatmen~ plant for some time. <br /> <br /> The following persons spoke in opposition to the application because of traffic <br />concerns: <br /> <br /> Anna Martinsen, 4038 Payne Road <br /> Don Savory, 6738 Rancho Court <br /> <br /> Mayor Philco. x declared ~he public hearing closed. <br /> <br /> Councilmember LeClaire stated she felt that mitigation measures had not been <br />properly addressed regarding traffic on Hopyard Road. <br /> <br /> Discussion ensued regarding the Environmental Impact Report and the need to <br />mitigate effects from the project~ Council was concerned that no detailed miti- <br />gation measures could be imposed. since the information in the Environmental Impact <br />Report and the project were both general in nature. The City Attorney advised the <br />Council of their obligation to make a finding that the adverse impacts would be <br />mitigated~ He suggested that the City Council impose conditions on the rezoning <br />to provide the environmental information and allow appropriate mitigation measures <br />to be imposed. The Council's at[ion would have to be referred back to the Plan- <br />ning Commission since no conditions were imposed by the Planning Conm~ission. <br /> <br /> After considerable discussion, it was moved by Councilmember Mercer, and <br />seconded by Councilmembe~TM Her!ihy, that Resolution No, 76-1i0, certifying that <br />the Environmental Impact Report on the Willow-West Properties had been reviewed <br />and considered, was in compliance with CEQA and the State guidelines, that the <br />appropriate boundaries of the area h~d been described, and that mitigation <br />measures had been proposed based on available information, and indicating that <br />additional information on the environmental impacts of development and the <br />manner in which they will be mitigated will have to be addressed in subsequent <br />Environmental Impact Reports pertaining to each phase of the projec't, be adopted. <br /> <br /> 5/10/76 <br /> <br /> <br />
