After discussion, it was moved by Councilmember Brandes, and seconded by <br />Councilmember Mercer, that Resolution No. 76-294, initiating a Zoning Ordi- <br />nance amendment to have the Planning Commission consider establishing as a <br />conditional use convenience markets in the C-C, C-N, and any other appropriate <br />commercial district, be adopted. <br />The roll call vote was as follows: <br />AYES: Councilmembers Brandes, Mercer, and Mayor Philcox <br />NOES: Councilmember Herlihy <br />ABSENT: Councilmember LeClaire <br /> <br /> Councilmember Herlihy stated he felt this was not proper action for the <br />City Council to take since it could affect businesses other than just con- <br />venience markets. <br /> <br /> Councilmember Brandes inquired as to when the report he requested re- <br />garding the Fire Division Mini-Pumper would be forthcoming. Fir. Campbell <br />advised that it was being prepared at the present time and should be com- <br />pleted soon. <br /> <br /> Mayor Philcox expressed concern regarding the Ordinance regulating <br />attendance at meetings of Boards and Commission members. After discussion, <br />Council concurred to lease the Ordinance as is. <br /> <br />CITY COUNCIL CALENDAR <br /> Mr. Edgar presented the Calendar for the Council's information. <br /> <br /> Council discussion ensued regarding a City Council meeting to discuss <br />LAVWMA matters. It was decided to meet at 7:30 P.M., on December 29th, <br />Pleasanton Council Chambers, to discuss LAVWMA matters. <br /> <br />EXECUTIVE SESSION: Litigation <br /> II~yor Philcox recessed the meeting to an Executive Session at 9:40 P.M., <br />to discuss litigation. <br /> <br /> }~yor Philcox reconvened the meeting at 10:]-5 P.M. <br /> <br /> It was moved by Councilmember Brandes, and seconded by Councilmember <br />Herlihy, that in the matter of the suit. against the City by Michael Lopez <br />the City Attorney was authorized to defend the City and prepare all legal <br />information necessary for the defense of the City in this case. <br />The roll call vote was as follows: <br />AYES: Councilmembers Brandes, Herlihy, Mercer, and }l~yor Philcox <br />NOES: None <br />ABSENT: Councilmember LeClaire <br /> <br /> It was moved by Councilmember Brandes, and seconded by Councilmember <br />Mercer, that the City not proceed with an appeal in the matter of Schlies <br />vs. the City of Pleasanton. <br />The roll call vote was as follows: <br />AYES: Councilmembers Brandes, Mercer, and Mayor Philcox <br />NOES: Councilmember Herlihy <br />ABSENT: Councilmember LeClaire <br /> <br />ADJOURN~iENT <br /> There being no further business at 10:20 P.M., it was moved by Council- <br />member Mercer, and seconded by Councihnember Herlihy, that the meeting be <br />a.djourned to meet again in Adjourned Regular Session at 7:30 P.M., on Decem- <br />ber 29, 1976, at 30 West Angela Street. <br />The roll call vote was as follows: <br />AYES: Councilmembers Brandes, Herlihy, Mercer, and Mayor Philcox <br />NOES: None <br />ABSENT: Councilmember LeClaire <br /> <br />Respectfully Submitted, <br /> <br />WILLIAM H.
