After discussion, it was moved by Councilmember Brandes, and seconded by Councilmember Mercer, that Resolution No. 76-294, initiating a Zoning Ordi- nance amendment to have the Planning Commission consider establishing as a conditional use convenience markets in the C-C, C-N, and any other appropriate commercial district, be adopted. The roll call vote was as follows: AYES: Councilmembers Brandes, Mercer, and Mayor Philcox NOES: Councilmember Herlihy ABSENT: Councilmember LeClaire Councilmember Herlihy stated he felt this was not proper action for the City Council to take since it could affect businesses other than just con- venience markets. Councilmember Brandes inquired as to when the report he requested re- garding the Fire Division Mini-Pumper would be forthcoming. Fir. Campbell advised that it was being prepared at the present time and should be com- pleted soon. Mayor Philcox expressed concern regarding the Ordinance regulating attendance at meetings of Boards and Commission members. After discussion, Council concurred to lease the Ordinance as is. CITY COUNCIL CALENDAR Mr. Edgar presented the Calendar for the Council's information. Council discussion ensued regarding a City Council meeting to discuss LAVWMA matters. It was decided to meet at 7:30 P.M., on December 29th, Pleasanton Council Chambers, to discuss LAVWMA matters. EXECUTIVE SESSION: Litigation II~yor Philcox recessed the meeting to an Executive Session at 9:40 P.M., to discuss litigation. }~yor Philcox reconvened the meeting at 10:]-5 P.M. It was moved by Councilmember Brandes, and seconded by Councilmember Herlihy, that in the matter of the suit. against the City by Michael Lopez the City Attorney was authorized to defend the City and prepare all legal information necessary for the defense of the City in this case. The roll call vote was as follows: AYES: Councilmembers Brandes, Herlihy, Mercer, and }l~yor Philcox NOES: None ABSENT: Councilmember LeClaire It was moved by Councilmember Brandes, and seconded by Councilmember Mercer, that the City not proceed with an appeal in the matter of Schlies vs. the City of Pleasanton. The roll call vote was as follows: AYES: Councilmembers Brandes, Mercer, and Mayor Philcox NOES: Councilmember Herlihy ABSENT: Councilmember LeClaire ADJOURN~iENT There being no further business at 10:20 P.M., it was moved by Council- member Mercer, and seconded by Councihnember Herlihy, that the meeting be a.djourned to meet again in Adjourned Regular Session at 7:30 P.M., on Decem- ber 29, 1976, at 30 West Angela Street.
