t3 <br /> <br />PUBLIC HEARINGS <br />Appeal of Eddie Sanders of a decision of the Board of Adjustment denying <br />Case U-76-12~ an application for aVariance to allow the installation of <br />free-standing sign in f~ont of theT-Eleven Store'located at 3760 Hopyard <br />Road~ zoning for the propertyis'C-N (Neighborhood Commerc.ial) District <br />(Continued Open from 8-9-76) <br /> Mr. Edgar stated that this application is almost identical to one filed <br />in 1974, which was denied at that time. <br /> <br /> Mr. Harris presented his report dated August 4, 1976, regarding this <br />matter. <br /> <br /> Mayor Philcox declared the public hearing open. <br /> <br /> The following person spoke in favor of the Appeal: <br /> <br /> Eddie Sanders, representing 7-Eleven Stores <br /> <br /> The following person spoke in opposition to the Appeal: <br /> <br /> Don Savery, 6738 Rancho Court, presented four suggestions for <br /> solution to the traffic and pedestrian problems in <br /> this area. <br /> <br /> Mr. Sanders responded to the traffic situation and its related problems. <br /> <br /> There being no further public testimony, Mayor Philcox declared the <br />public hearing closed. <br /> <br /> After discussion and determining that Council could not make the find- <br />ings necessary to grant the Variance, it was moved by Councilmember LeClaire, <br />and seconded by Councilmember Herlihy, that Resolution No. 76-194, denying <br />the appeal of Eddie Sanders of a decision of the Board of Adjustment denying <br />Case U-76-12, an application for a Variance to allow the installation of a <br />free-standing sign in front of the 7-Eleven Store located at 3760 Hopyard <br />Road, be adopted. <br />The roll call vote was as follows: <br />AYES: Councilmembers Herlihy, LeClaire, Mercer, and Mayor Philcox <br />NOES: Councilmembers Brandes <br />ABSENT: None <br /> <br /> Council requested that the suggestions of Don Savery regarding allevia- <br />tion of traffic and pedestrian problems in the area of West Las Positas and <br />Hopyard Road intersection, as follows: (1) removal of hedge and evergreens; <br />(2) the curb cuts be designated either as entrance or exit and clearly posted; <br />(3) warning signs for two way bike traffic should be established at each exit; <br />and (4) no additional signs which will hinder visibility should be constructed, <br />be referred to the Traffic Committee for further study. <br /> <br />MEETING OPEN TO THE PUBLIC (Contd.) <br /> Mrs. Salle Larson addressed the Council regarding the Aquathon to be held <br />on August 24, 1976, at the Swim Center, in which the Council and staff will <br />participate. <br /> <br />PUBLIC HEARINGS (Contd.) <br />Review and Consideration of a rate increase for Tele-Vue Systems} Inc. <br /> Mr. Edgar presented Mr. Walker's report-.dated August 3, 1976, regarding <br />request for rate increase, and his report dated August 12, 1976, regarding <br />environmental analysis of rate increase for cable T.V. <br /> <br /> Mr. Walker reviewed his report in detail for the information of the <br />Council. <br /> <br /> Mayor Philcox declared the public hearing open. <br /> <br /> Mr. Bill Lilly, Manager of Televue Systems, stated that was the first <br /> request for rate increase in seven years, and that it was necessary be- <br /> cause of increased costs. <br /> <br /> 2. 8/23/76 <br /> 1 <br /> <br /> <br />
