Mr. Harris presented his report dated August 4, 1976, regarding this matter. Mayor Philcox declared the public hearing open. The following person spoke in favor of the Appeal: Eddie Sanders, representing 7-Eleven Stores The following person spoke in opposition to the Appeal: Don Savery, 6738 Rancho Court, presented four suggestions for solution to the traffic and pedestrian problems in this area. Mr. Sanders responded to the traffic situation and its related problems. There being no further public testimony, Mayor Philcox declared the public hearing closed. After discussion and determining that Council could not make the find- ings necessary to grant the Variance, it was moved by Councilmember LeClaire, and seconded by Councilmember Herlihy, that Resolution No. 76-194, denying the appeal of Eddie Sanders of a decision of the Board of Adjustment denying Case U-76-12, an application for a Variance to allow the installation of a free-standing sign in front of the 7-Eleven Store located at 3760 Hopyard Road, be adopted. The roll call vote was as follows: AYES: Councilmembers Herlihy, LeClaire, Mercer, and Mayor Philcox NOES: Councilmembers Brandes ABSENT: None Council requested that the suggestions of Don Savery regarding allevia- tion of traffic and pedestrian problems in the area of West Las Positas and Hopyard Road intersection, as follows: (1) removal of hedge and evergreens; (2) the curb cuts be designated either as entrance or exit and clearly posted; (3) warning signs for two way bike traffic should be established at each exit; and (4) no additional signs which will hinder visibility should be constructed, be referred to the Traffic Committee for further study. MEETING OPEN TO THE PUBLIC (Contd.) Mrs. Salle Larson addressed the Council regarding the Aquathon to be held on August 24, 1976, at the Swim Center, in which the Council and staff will participate. PUBLIC HEARINGS (Contd.) Review and Consideration of a rate increase for Tele-Vue Systems} Inc. Mr. Edgar presented Mr. Walker's report-.dated August 3, 1976, regarding request for rate increase, and his report dated August 12, 1976, regarding environmental analysis of rate increase for cable T.V. Mr. Walker reviewed his report in detail for the information of the Council. Mayor Philcox declared the public hearing open. Mr. Bill Lilly, Manager of Televue Systems, stated that was the first request for rate increase in seven years, and that it was necessary be- cause of increased costs. 2. 8/23/76 1
