The roll call vote was as follows: AYES: Councilmembers Brandes and LeClaire NOES: Councilmember Mercer and Mayor Philcox ABSENT: Councilmember Herlihy It was moved by Councilmember Mercer, and seconded by Mayor Philcox, to approve the application of Page Binkley for rezoning to allow a 28-unit condominium project at Black Avenue and Hopyard Road. The roll call vote was as follows: AYES: Councilmember Mercer and Mayor Philcox NOES: Councilmembers Brandes and LeClaire ABSENT: Councilmember Herlihy Mayor Philcox asked the City Attorney if this item would be automatically continued to the next meeting because of the preceding motions and votes. The City Attorney advised he would have to check into the matter and advise later. Councilmember Brandes stated that although he felt this application was an improper rezoning he thought a continuance would be in order in fairness to the applicant. It was moved by Councilmember Brandes, and seconded by Councilmember Mercer, to continued this item thirty days. Mayor Philcox stated he would be on vacation at that time. Councilmember Brandes withdrew his motion and Councilmember Mercer withdrew his second. After further discussion, it was moved by Mayor Philcox, and seconded by Councilmember LeClaire, that the public hearing regarding the application of Page Binkley to rezone approximately 2.1 acres on the southeast corner of Black Avenue and Hopyard Road from the RM-4000 (Multiple Residential) District to the PUD'(Planned Unit Development) District and for approval of a development plan for a proposed 28-unit condomimium project on the site, be reopened and con- tinued to the meeting of July 11, 1977, 8:00 P.M., Pleasanton Council Chambers.
