The roll call vote was as follows: <br />AYES: Councilmembers Brandes and LeClaire <br />NOES: Councilmember Mercer and Mayor Philcox <br />ABSENT: Councilmember Herlihy <br /> <br /> It was moved by Councilmember Mercer, and seconded by Mayor Philcox, to <br />approve the application of Page Binkley for rezoning to allow a 28-unit <br />condominium project at Black Avenue and Hopyard Road. <br />The roll call vote was as follows: <br />AYES: Councilmember Mercer and Mayor Philcox <br />NOES: Councilmembers Brandes and LeClaire <br />ABSENT: Councilmember Herlihy <br /> <br /> Mayor Philcox asked the City Attorney if this item would be automatically <br />continued to the next meeting because of the preceding motions and votes. The <br />City Attorney advised he would have to check into the matter and advise later. <br /> <br /> Councilmember Brandes stated that although he felt this application was <br />an improper rezoning he thought a continuance would be in order in fairness to <br />the applicant. <br /> <br /> It was moved by Councilmember Brandes, and seconded by Councilmember Mercer, <br />to continued this item thirty days. <br /> <br /> Mayor Philcox stated he would be on vacation at that time. <br /> <br /> Councilmember Brandes withdrew his motion and Councilmember Mercer withdrew <br />his second. <br /> <br /> After further discussion, it was moved by Mayor Philcox, and seconded by <br />Councilmember LeClaire, that the public hearing regarding the application of <br />Page Binkley to rezone approximately 2.1 acres on the southeast corner of Black <br />Avenue and Hopyard Road from the RM-4000 (Multiple Residential) District to the <br />PUD'(Planned Unit Development) District and for approval of a development plan <br />for a proposed 28-unit condomimium project on the site, be reopened and con- <br />tinued to the meeting of July 11, 1977, 8:00 P.M., Pleasanton Council Chambers. <br />The roll call vote was as follows: <br />AYES: Councilmembers Brandes, LeClaire, Mercer, and Mayor Philcox <br />NOES: None <br />ABSENT: Councilmember Herlihy <br /> <br />Consideration of Comments and Recommendations RegardinE..
