Application of the Planning Commission for an amendment to Chapter 2~. Title II <br /> of the Ordinance Code of the City of Pleasanton to create new commercial use <br /> ~a.teSories and to make such uses permitted uses in various zoning districts <br /> Mr. Harris presented his report dated June 21, 1977, regarding this matter. <br /> <br /> Mayor Philcox declared the public hearing open. <br /> <br /> No one in the audience spoke in favor of or in opposition to this item. <br /> Mayor Philcox declared the public hearing closed. <br /> <br /> It was moved by Councilmember Brandes, and seconded by Councilmember Mercer,. <br />that Ordinance No. 823, to be read by title only and waiving further reading <br />thereof, amending Sections 2-5.21, 2-5.25, and 2-5.27 of Article 2 (Definitions), <br />Chapter 2 (Zoning), Title Ii (Zoning and Development) by adding definitions for <br /> "Nu ", <br /> rsery "Garden Center", and "Plant Store"; amending Sections 2-7.08(a) <br />(Permitted and Conditional Uses), Article 8 (C Commercial District), Chapter 2, <br />Title II; and amending Sections 2-7.20(3), 2-7.21(1)(j), and 2-7.21(3) of <br />Article 9 (I Industrial District), Chapter 2, Title II of the Ordinance Code <br />of the City of Pleasanton, be introduced. <br />The roll call vote was as follows: <br />AYES: Councilmembers Brandes, LeClaire, Mercer, and Mayor Philcox <br />NOES: None <br />ABSE~f: Councilmember Herlihy <br /> <br />Review of Negative Declaration for a Project to Construct a 28-unit Condominium <br />at Black Avenue and Hopyard Road (Contd. Open from 6-13-77)' <br /> Mr. Harris presented his report dated June 23, 1977, regarding this matter. <br /> <br /> Mayor Philcox declared the continued public hearing Open. <br /> <br /> No one in the audience spoke in favor of or in opposition to this item. <br /> Mayor Philcox declared the public hearing closed. <br /> <br /> Discussion occurred among the Council whether a Negative Declaration was <br />appropriate due to the density of the project. The City Attorney read to City <br />Council the provisions of the City's environmental guidelines dealing with <br />significant effects and advised Council that they would have to make a finding . <br />that an Environmental Impact Report or Negative Declaration was appropriate. <br /> <br /> After extensive discussion, it was moved by Councilmember Mercer, and <br />seconded by Mayor Philcox, finding the project would have no significant <br />adverse impact on the environment, approve the Negative Declaration subject <br />to all conditions contained in Planning Commission Resolution No. 1519, <br />authorize the City Attorney to rewrite the Negative Declaration statement <br />regarding sewage, and determining after a review of the environmental guide- <br />line procedures for Negative Declarations and Environmental Impact Reports, <br />that a Negative Declaration is appropriate. <br />The roll call vote was as follows: <br />AYES: Councilmember Mercer and Mayor Philcox <br />NOES: Councilmembers Brandes and LeClaire <br />ABSENT: Councilmember Herlihy <br /> <br /> 4. 6/27/77 <br /> <br /> <br />
