Withers reimbursement and the two cases were different in the Councii's judge- <br />ment. <br /> <br /> Mr. Thurman Claudill, St. Augustine Street, spoke in support of reimbursement <br />for legal costs to Lts. Laurence and Hinkston. <br /> <br />PUBLIC HEARINGS <br />Application of the City Council to rezone approximately 53 acres located south of <br />Minnie Street between Sunol Boulevard and the eastern City Limit line from RM-2500 <br />(b~lti-Family Residential) District~ R-1-6500 <Single Family Residential.) District <br />and A (Agricultural) District to PUD (Planned Unit Development) District or any .. <br />other Zoning District that the City Council finds is appropriate <br />(Contd. Open from 2-14-77, 2-28-77~ 3.~28-77, 4-25-7~, and 5-23-77) <br /> Mr. Harris presented his report dated June 21, 1977, regarding this matter. <br /> <br /> Mayor Philcox declared the continued public hearing Open. <br /> <br /> Councilmember LeClaire expressed concern regarding the long period of time <br />being required for resolution of this item. <br /> <br /> Mr. Harris stated that staff and developer were making progress toward the <br />preparation of a plan for development of the property but there were still <br />problems to be ironed out. <br /> <br /> Mr. John P. Corley, Attorney representing the developer, stated his client <br />~uld be willing to present a plan for review by City Council at its meeting of <br />July llth. <br /> <br /> ~o Scheidig advised this would be an improper activity for Council to engage <br />in and explained that the development plan would go before the Planning Commission <br />first once the zoning to PUD was acted upon and assuming it was approved. The <br />proper procedure for handling a PUD is not for the Council to look at development <br />proposals before the zoning was established and the Planning Comanission had <br />passed on the plan. <br /> <br /> There being no further public testimony, Mayor Philcox declared the public <br />hearing closed. <br /> <br /> After discussion, it was moved by Councilmember Brandes, and seconded by <br /> Cit ' <br />Councilmember LeClaire, that Resolution No. 77-178, denying the y s applica- <br />tion to rezone approximately 53 acres located south of Minnie Street between <br />Sunol Boulevard and the eastern City Limit line from RM-2500 (Multi-Family <br />Residential) District, R-1-6500 (Single Family Residential) District and A <br />(Agricultural) District to PUD (Planned Unit Development) District or any <br />other Zoning District that the City Council finds is appropriate, be adopted. <br />The roll call vote was as follows: <br />AYES: Councilmembers Brandes, LeClaire, Mercer, and Mayor Philcox <br />~OES: None <br />ABSEnt: Councilmember Herlihy <br /> <br /> Mr. Scheidig advised that since the City had initiated the rezoning, the <br />property owner was not precluded from submitting a PUD zoning request and <br />development plan for consideration. <br /> <br /> 3. 6/27/77 <br /> <br /> <br />
