It was moved by Councilmember Brandes, and seconded by Councilmember Mercer, <br />that Resolution No. 77-163, g~anting Pleasanton Garbage Service a rate increase <br />of 27%, effective April 1, 1977, subject to the various ~ccounting criteria set <br />forth in the draft resolution with the addition of an annual audited financial <br />statement to be prepared by an auditing firm and with a format picked by the <br />City, that any capital expenditures of $10,000.00 or more must be submitted to <br />the City Manager for review and approval, and authorizing the Mayor to sign a <br />modification to the Contract with Pleasanton Garbage Service as deemed necessary <br />by the City Attorney, be adopted. <br />The roll call vote was as follows: <br />AYES: Councilmembers Brandes, Herlihy, LeClaire, Mercer, and Mayor Philcox <br />NOES: None <br />ABSENT: None <br /> <br /> The City Attorney was directed to work with the Attorney for Pleasanton <br />Garbage Service to put the proposed resolution in proper form, to be reviewed <br />by Councilmembers Brandes and Mercer. <br /> <br />SPEC~_AL REPORTS <br />Presentation b7 Willow West~ Re: Lon5 Term SeweraSe Service <br /> Mr. Richard W. Karn, Bissell and Karn, San Leandro, representing Willow-West <br />Properties, reviewed the history of this property on Hopyard Road. He stated <br />there were developers interested in the parcel of land and requested City Council <br />and staff assistance for an interim solution to the sewer problem as well as long <br />term_ sewerage service. <br /> <br /> Mayor Philcox stated that the City could not guarantee sewer capacity and <br />indicated that any interim proposals should be submitted to the staff for re- <br />view. <br /> <br />Discussion Re: Report of CARD Concernins Fairg~ounds <br /> Mrs. Anna Martinsen, 1890 Brooktree Court, urged Council to review the <br />Agreement with the Fairgrounds to see if some fee could be charged for sewer <br />service. She contended the Agreement was out-of-date and that Pleasanton is <br />losing large sums of revenue which it is fairly entitled to. <br /> <br /> Mr. Francis Headley, 1640 Orchard Way, read City Council Minutes of 1958 <br />in which the Fairground Agreement was authorized. He stated he felt that <br />sewerage treatment fees should be charged to the Fairgrounds. <br /> <br /> Mr. Oliver Anjo, 2403 Raven Road, stated that CARD was in no way trying to <br />embarrass the Council but were attempting to assist the City in a complete all- <br />encompassing study of various topics, of which the Fairgrounds sewer service <br />charge issue was only a small area. He stated he felt the City should try to <br />get some relief from the Fairgrounds for sewer service charges even if it had <br />to be pursued to the Courts. <br /> <br /> Councilmember Herlihy stated that the Fair Liaison Committee members had <br />tried for years to re-negotiate the Agreement with the Fairgrounds with no <br />success. He stated that since the City Attorney had advised the Agreement <br />was legal and binding that the matter should not be pursued further.
