Mayor Philcox stated that Ken Scheidig had just completed four years as City Attorney with the City. Council commended Mr. Scheidig on his outstand- ing service to the City. Councilmember Mercer asked when Council Committee assignments would be made. Mayor Philcox advised appointments would be made this week. Councilmember Mercer asked if it would be possible to require a person circulating a petition to put on the petition arguments for and against the item in order to allow the public to be better informed before signing such a document. Mr. Scheidig advised that this may be possible, but problem would be how to get opposition position. Councilmember Mercer indicated he would get together with Mr. Scheidig to discuss more fully. Mayor Philcox stated that A. C. Transit would be conducting a study regarding transportation needs of the handicapped, and asked if the City would be interested in participating in this study to include the Valley, at an approximate cost of $500.00. After discussion, Council deferred decision on this matter. CI.TY COUNCIL CALENDAR Mr. Campbell presented the Calendar for the Council's information. EXECUTIVE SESSION Mayor Philcox adjourned the meeting to an Executive Session at 11:55 P.M., to discuss potential litigation regarding sewer connection request and pre- annexation agreement with Mr. and Mrs. Mitchell on Vineyard Avenue. Mayor Philcox reconvened the meeting at 12:05 A.M. Councilmember LeClaire advised that she would like Council to discuss its position regarding appeal of Nipper development. She advised that City can appeal and felt City should. Discussion ensued. After discussion, it was moved by Councilmember LeClaire, and seconded by Councilmember Brandes, that Resolution No. 77-126, authorizing an appeal of Carl Mipper's proposed development, be adopted. The roll call vote was as follows: AYES: Councilmembers Brandes, Herlihy, LeClaire, Mercer, NOES: ~ Mayor Philcox ABSENT: None Mr. Campbell then indicated to the Council that he had prepared a memorandum setting forth various concerns of the City regarding its negotiations with VCSD for consolidation of sewage treatment plants. Mr. Campbell presented Council with his memorandum dated April 21, 1977. Council okayed staff (AoC.M. and C.A.) discussing these items with State to get State reaction. ADJOURNMENT There being no further business at 12:15 A.M., it was moved by Councilmember Mercer, and seconded by Councilmember Herlihy, that the meeting be adjourned to meet again in Adjourned Regular Session at 6:45 P.M., on April 26, 1977, at the Pleasanton Council Chambers. 11. 4/25/77
