District to the PUD (Planned Unit Development) District and for <br />~rov~! of a development .p~an for a p.ro.Fo~.ed 13-Unit' .,~arden court" home sub- <br />allvision on the 1.42 acre site <br /> Mr. t~rris presented his report dated March 21, 1977, regarding this matter. <br /> <br /> Mr. Scheidig stated the environmental assessment - the attached negative <br />declaration for this project - would have to be acted on concurrently. <br /> <br /> Mayor Philcox declared the public hearing open on the application and the <br />negative declaration determination. <br /> <br /> Mr. Hugh Anton, representing J. Jack Bras, spoke in favor of the application. <br /> <br /> Mr. Chuck Seymour, 492 San Gabriel Court, spoke in opposition to this item <br />because of lack of sew.er availability to the proposed development. <br /> <br /> There being no further public testimony, Mayor Philcox declared the public <br />hearing closed. <br /> <br /> After discussion, it was moved by Councilmember Herlihy, and seconded by <br />Councilmember Brandes, that Resolution No. 77-87, determining that PUD-77-1 <br />would not have a significant adverse impact on the environment and that the <br />negative declaration is appropriate for the project, be adopted. <br />The roll call vote was as follows: <br />AYES: Councilmembers Brandes, Herlihy, LeClaire, Mercer, and Mayor Philcox <br />~OES: None <br />ABSENT: None <br /> <br /> Councilmember LeClaire stated that Conditions 3 and 14, as set forth by <br />the Planning Commission were identical and therefore one should be eliminated. <br /> <br /> 2. 3/28/77 <br /> <br /> <br />
