285 <br /> <br /> After discussion, it was moved by Councilmember Herlihy, and seconded by <br />Councilmember Mercer, authorizing the Mayor to support SB-4, the Returnable <br />Bottle Bill, at the Mayors' Conference, and instructing the City Attorney to <br />advise the appropriate legislators of this stand. <br />The roll call vote was as follows: <br />AYES: Councilmembers Brandes, Herlihy, LeClaire, Mercer, and Mayor Philcox <br />NOES: None <br />ABSENT: None <br /> <br /> Councilmember Herlihy requested, and the Council approved, investigation <br />by the City Attorney's office into the possibility of establishing a bottle <br />return ordinance in Pleasanton. <br /> <br />REPORTS OF BOARDS AN~ COMMISSIONS <br /> There were no reports of Boards and Commissions presented at this meeting. <br /> <br />REPORTS OF THE CITY MANAGER <br />Further ReDort~ Re: Cheese FactOry Permit <br /> ~. Campbell presented his report dated February 23, 1977, regarding this <br />matter. <br /> <br /> Mr. Scheidig explained the proposed changes in the Permit, especially to <br />the hold harmless provisions of Article 16. <br /> <br /> Councilmember Mercer expressed concern regarding what he considered in- <br />equities between the Kaiser Permit and the proposed Cheese Factory Permit, <br />and the provisions of the Ordinance. <br /> <br /> It was moved by Councilmember Mercer, that before the Cheese Factory <br />Permit is considered, that the staff be instructed to review the Ordinance and <br />see what can be done to rectify the inequity between the Kaiser Permit and the <br />proposed Cheese Factory Permit. <br /> <br /> The motion died for lack of a second. <br /> <br /> Council discussion ensued regarding a revocation clause in the Permit, <br />length of time for Permit, review for modification, etc. Council determined <br />not to include a revocation clause. <br /> <br /> It was moved by Mayor Philcox, and seconded by Councilmember Brandes, <br />instructing staff to review Ordinance No. 422 regarding Discharge Require- <br />ments, and to review the outstanding discharge permits to determine if any <br />changes are required in view of apparent differences between the outstanding <br />permit and the proposed Cheese Factory Permit. <br />The roll call vote was as follows: <br />AYES: Councilmembers Brandes, Herlihy, Mercer, and Mayor Philcox <br />~OES: Councilmember LeClaire <br />ABSENT: None <br /> <br /> It was moved by Mayor Philcox, and seconded by Councilmember Brandes, <br />that Resolution No. 77-61, approving the Cheese Factory I~ste Discharge <br />Permit subject to amendments to Article 16 regarding violations and Article <br />17 regarding modifications, be adopted. <br /> <br /> 8. 2/28/7'7 <br /> <br /> <br />
