<br /> It was moved by Councilmember Brandes, and seconded by Councilmember Mercer,
<br />that the City of Pleasanton accept the figure of $1,147,221 for the total costs
<br />of the buy-in to the VCSD Sewage Treatment Plant as recommended by the State
<br />Water Resources Control Board staff in their letter dated September 8, 1977.

<br /> It was moved by Councilmember Mercer, and seconded by Councilmember Brandes,
<br />that in the event that Volk-McLain is successful in its appeal of the judgement
<br />in favor of VCSD and the June 28, 1965, Volk-McLain/VCSD Agreement is deemed
<br />valid, then the City of Pleasanton agrees to pay the local share of costs for
<br />the Phase III expansion of the VCSD Treatment Plant estimated at $744,260 and,
<br />for Sunol Plant capacity in excess of 1.5 mgd, the City agrees to pay, per said
<br />1965 Agreement, $145.00 per single family equivalent connection; $110.00 per
<br />multiple connection; and for commercial/industrial connections the single family
<br />dwelling unit equivalent (280 gallons per day).

<br /> It was moved by Councilmember Mercer, and seconded by Councilmember Brandes,
<br />that the City of Pleasanton agrees to pay to VCSD, for any connection beyond 1.5
<br />mgd, the then current connection fee up to a maximum of $735 per connection.

<br /> It was moved by Councilmember Mercer, and seconded by Councilmember Herlihy,
<br />that the City of Pleasanton agrees to pay, subject to an agreement between the
<br />City and VCSD relating to the buy-in, a proportionate share of the legal costs
<br />incurred by VCSD from September 15, 1977, relating to its litigation with Volk-
<br />McLain plus interest on the present judgement against VCSD of $29,052.48. The
<br />City's proportionate share will be determined by the City's capacity in the VCSD
<br />Plant, approximately 28 percent.

<br /> It was moved by Councilmember Brandes, and seconded by Councilmember Herlihy,
<br />that the City of Pleasanton agrees to the establisbsnent of a separate expansion
<br />fund for City and VCSD. It is the position of the City of Pleasanton that the
<br />sewer connection fee should not exceed a maximum of $735 per connection. All
<br />connection fees collected in Pleasanton, beyond 1.5 mgd will be placed in the
<br />expansion fund for Pleasanton. Any charges for plant depreciation or adminis-
<br />tration shall be derived from monthly service charges.
