Adoption of R~solution No. 78-129, amending resolutions establishing <br /> Bond ~turity Schedules and Interest Rates in Assessment Districts No. <br /> 1974-1, 1974-2, 1974-3, 1974-4 and 1974-5, Stoneridge Center. <br /> <br />The roll call vote was as follows: <br />AYES: Councilmen Brandes, Butler, Kephart, Wood, and Mayor Mercer <br />NOES: None <br />ABSENT: None <br /> <br />MEET!~G OPEN TO THE PUBLIC <br /> Mr. Robert Grove, 5555 San Jose Drive, President of the Mission Park <br />Homeo~,mers Association, requested Council to review the zoning on two parcels <br />zoned RjI-1500 and one zoned R-1-6500. He stated that residents in the area <br />wera concerned about the number of multiples being allowed in Mission Park. <br />Me requested this matter be considered before sewer permits were allocated <br />under the Residential Allocation Program on June 5, 1978. Mr. Grove stated <br />he felt it would be more difficult to stop a project after sewer permits had <br />been allocated. <br /> <br /> In response to a question from Council, Mr. Levine advised that while a <br />rezoning of properties for which design had already been approved was permitted <br />under the caselaw, as no vested right accrues until after construction based on <br />a valid building permit has taken place, rezoning the property at this stage <br />might provide factual data that could be used by the developer in a law suit <br />te convince a judge that the City was acting arbitrary. <br /> <br /> After discussion, Council took no action on this matter. <br /> <br />AP2OIN~E.NT. OF IlOUSING AUTHORITY BOARD MEMBER <br /> Mayor Mercer stated that the Council had interviewed five candidates for <br />appointmsnt to the Housing Authority Board on May 16, 1978, and a vote taken <br />at that time, but since no candidate had received three votes, the matter had <br />been continued to this meeting for final decision. <br /> <br /> 2. 5/23/78 <br /> <br /> <br />
