Mayor Mercer declared the public hearing closed. It was moved by Councilmember Brandes, and seconded by Councilmember Butler, that Resolution No. 78-101, overruling objection and proceeding with abatement of weeds, rubbish orrefuse upon or in front of certain described properties within the City of Pleasanton which constitute public nuisances, be adopted. The roll call vote was as follows: AYES: Councilmembers Brandes, Butler, Kephart, Wood, and Mayor Mercer NOES: None ABSENT: None Weed Abatement Contractor for 1978 Mr. Levine presented his report dated April 25, 1978, regarding this matter. It was moved by Councilmember Brandes, and seconded by Councilmember Butler, that Resolution No 78-102, awarding the bid for Nuisance Abatement Contractor . for 1978 to Spilker Tree Service, Inc., Concord, for an overall hourly amount of $21.61 per hour, be adopted. Way along the extension of Muirwood Drive Application of Falender Homes for a .planned unit development for a medium density__ residential development comprising. 51 single family~ zero-lot 'link h~mes similar to the existin,5 Oakhill development, on a 12-acre site, located as described in the environmental review above Mr. Harris presented his report dated April 17, 1978, regarding these two matters. }~yor Mercer declared the public hearing open on the environmental impact report and the application. Mr. Fred Falender, applicant, stated he was in general agreement with the recommendations and conditions of City staff and the Planning Commission, and urged Council approval of the environmental impact report and the application. Ms. Rita Tomhey, 3761 Ashwood Drive, commented on the proximity of the houses to the freeway, stating there were other houses that were closer. There being no further public testimony, Mayor Mercer declared the public hearing closed on the environmental impact report and the application. Councilmember Butler stated he felt the energy conservation condition placed on the environmental impact report was unnecessary due to new energy conservation regulations required by law on all new construction. Councilmember Brandes voiced strong opposition to any development of the property on the East side of Muirwood Drive, and requested that this parcel be ~{cluded from the development plan due to noise problem. 6. 4/25/78
