365 <br /> <br /> MINUTES <br /> of <br /> THE MEETING <br /> of <br /> THE CITY COUNCIL <br /> <br /> April 14, 1978 <br /> <br />CALL TO ORDER <br /> Mayor Kenneth Mercer called the Special Meeting of the City Council to <br />order at 5:30 P.M. <br /> <br />ROLL CALL <br />The roll call is recorded as follows: Councilmembers Brandes, Kephart, <br />Wood, and ~[%yor Mercer were present Mr Brown, City Manager, and Mr. Levine, <br />City Attorney, were present <br /> ' <br /> <br />CONSIDERATION OF APPOINTMENT TO CITY COUNCIL <br /> Mayor Mercer stated that the reason for the Special Meeting was to appoint <br />a Councilmember to fill the position vacated by William Herlihy. <br /> <br /> Mayor Mercer asked if any members of the audience wished to address the <br />Council regarding this matter. <br /> <br /> Mr. Eric Granville, 1987-H Santa Rita Road, commented on the method by <br />which the Council was going about filling the Council vacancy. Mr. Granville <br />felt the person who was the first runnerup on the last election should be <br />considered by the Council for the position. <br /> <br /> Mayor Mercer provided statistical information regarding how City Councils <br />since 1894 have filled vacancies, stating that only three times was a vacant <br />City Council seat filled by the first runnerup in the last election, and the <br />remaining twelve times the seat was filled by the appointment of a person who <br />had not been a candidate in the last election. <br /> <br /> Councilmember Brandes stated he felt that an election should be held to <br />fill the vacancy on the City Council but that the consideration to have a <br />full Council was overriding. <br /> <br /> It was moved by Councilmember Brandes, and seconded by Councilmember Wood, <br />that Resolution No. 78-75, appointing Robert E. Butler, 3831 Pinot Court, to <br />serve as Councilmember on the Pleasanton City Council until the November Ballot, <br />be adopted. <br />The roll call vote was as follows: <br />AYES: Councilmembers Brandes, Wood, and Mayor Mercer <br />NOES: Councilmember Kephart <br />ABSENT: None <br /> <br /> ~yor Mercer asked Mr. Butler if he would be willing to serve as a member <br />of the City Council until the November election. Mr. Butler stated he would <br />be willing to do so. <br /> <br /> <br />
