10-7 <br /> <br /> MINUTES <br /> of <br /> THE MEETING <br /> of <br /> THE CITY COUNCIL <br /> <br /> November 21~ 1978 <br /> <br />CALL TO ORDER - PLEDGE TO THE FLAG <br /> Mayor Kenneth Mercer called the Regular Meeting of the City Council to order at <br />7:30 P.M., and then led the Pledge of Allegiance to the flag. <br /> <br />RO'LL CALL <br /> Shirley McDougall, Secretary Pro Tem, called the roll which is recorded as <br />follows: Councilmembers Brandes, Butler, Kephart, Wood, and Mayor Mercer were <br />present. Mr. Brown, City ~nager, Mr. Levine, City Attorney, and Mr. Harris, <br />Director of Planning and Community Development, were present. <br /> <br />AGE~TDA A,ME~N~]~,~NTS <br /> Mr. Levine requested that an Executive Session be held at the conclusion of <br />item 8 to discuss pending litigation. <br /> <br />CO>FFIRMATION OF ELECTION RESD~LTS <br /> Mr. Brown advised that the election results were not yet available concerning <br />the recent special municipal election for City Councilmember. <br /> <br />CO}iSEN~f CALENDAR <br /> It was moved by Councilmember Brandes, and seconded by Mayor Mercer, that the <br />following items listed on the Consent Calendar be approved: <br /> <br />a. Adoption of Resolution No. 78-287, approving Progress Payment No. I, to RaS~nond <br /> J. Haug Excavating: for Peters Avenue Waterline and Sewerline, in the amount of <br /> $6,794.07. <br /> <br />b. Adoption of Rasoiution No. 78-288, approving Progress Payment No. 2, to Mountain <br /> Construction, inc., for Central Business District Storm Drainage Outfall, Pro- <br /> ject No. 78-3, in the amount of $61,375.50. <br /> <br />The roll call vote was as follows: <br />AYES: Councilmen Brandes, Butler, Kephart, Wood, and I~yor Mercer <br />NOES: None <br />ABSD~: None <br /> <br />>b~TTETRS INITIATED BY COUNCILMEMBERS <br /> There were no matters initiated by Councilmembers presented at this meeting. <br /> <br />CITY COUNCIL CO~.IITTEE REPORTS <br /> Mayor Mercer requested that the design review for the Van Bokkelen-Cole <br />shopping center to be located at W. Las Positas and Santa Rite Road be appealed <br />with regard to the northeast driveway, restrictions of the back, elevations, <br />and open space on the southeast corner of the property. <br /> <br /> Councilmember Brandes indicated that the developer has taken great efforts <br />to mitigate the concerns of the citizens toncerning this develop.~ent, and he <br />felt no further action was necessary at this time. <br /> <br /> <br />
