H. C. Elliott, Sr., stated that he regretted the building discrepancies that <br />had occurred and that the problems were being taken care of as quickly as possible <br />on his present development. <br /> <br /> There being no further public testimony, Mayor Mercer declared the public <br />hearing closed on the negative declaration and the application. <br /> <br /> After discussion, it was moved by Councilmember Butler, and seconded by Mayor <br />Mercer, that Resolution No. 78-251, determining on the basis of a review of initial <br />envirop~ental study done for this project, find that PUD-78-3 would not have any <br />significant adverse effects on the environment because conditions 1, 7, 33, 34 and <br />35 of Planning Commission Resolution No. 1664 would reduce those impacts to an <br />insignificant level, and that a negative declaration is appropriate for PUD develop- <br />ment plan approval with regard to a fourteen acre site between Tawny Drive and <br />Palomino Drive immediately east of Pico Avenue - six and nine-tenths acres is pro- <br />pose~ for residential townhouse development and seven and one-tenth acres is pro- <br />posed as a neighborhood shopping center, be adopted <br /> ' <br />The r~].i call vote was as follows: <br />AYES: Councilmen Brandes, Butler, Kephart, Wood, and Mayor Mercer <br />NOES: None <br />ABSEnt: None <br /> <br /> i[ was moved by Councilmember Brandes, and seconded by Councilmember Butler, <br />that an ordinance amending Ordinance No. 807 to delete the acreage restriction <br />as set forth in subparagraphs 1 and 2 of the ordinance be read by title only and <br />waive further reading thereof. <br />The roll call vote was as follows: <br />AYES: Councilmen Brandes, Butler, Kephart, Wood, and ~yor Mercer <br />NOES: None <br />ABSENT: None <br /> <br /> It was moved by Councilmember Brandes, and seconded by Councilmember Butler, <br />thai Ordinance No. 864, amending Ordinance No. 807 to delete the acreage restric- <br />tions ~s set forth in sub-paragraphs 1 and 2 of the ordinance and substitute a <br />l~it on the number of dwelling units which can be constructed on the subject <br />proper~y (the max~um should be 70 dwelling units), be introduced. <br />The roll call vote was as follows: <br />AYES; Councilmen Brandes, Butler, Kephart, Wood, and Mayor Mercer <br />NOES: None <br />ABSE)~: None <br /> <br /> it was moved by Councilmember Brandes, and seconded by Councilmember Butler, <br />t.hat an ordinance amending sub-paragraph No. 3 of Ordinance No. 807 be read by <br />title only and waive further reading thereof. <br />The roll call vote was as follows: <br />AYES: Councilmen Brandes, Butler, Kephart, and }~yor Mercer <br />NOES: Councilman Wood <br />ABSENT: None <br /> <br /> It was moved by Councilmember Brandes, and seconded by Councilmember Butler, <br />that Ordinance No. 865, amending sub-paragraph No. 3 of Ordinance No. 807 as <br />follows: "Development of the multiple family residential area should not commence <br />until construction has started on at least 50% of the commercial portion of the <br />subject property; construction will have been deemed started once the foundations <br />or slabs of the commercial buildings have been poured", be introduced. <br /> <br /> 4. 10/3/78 <br /> <br /> <br />
