MINUTES <br /> of <br /> THE MEETING <br /> of <br /> THE CITY COUNCIL <br /> <br /> September 5, 1978 <br /> <br />CALL TO ORDER <br /> Mayor Kenneth Mercer called the Adjourned Regular Meeting of the City Council <br />to order at 6:00 P.M. <br /> <br />ROLL CALL <br /> The roll call is recorded as follows: Councilmembers Brandes, Butler, Wood, <br />and Mayor Mercer were present. Councilmember Kephart was absent. Mr. Brown, <br />City Manager, Mr Levine, City Attorney, and Mr. Campbell, Director of Public <br />Works and Utilities, were present. <br /> <br />PUBLIC HEARINGS <br />Resolution of Necessity for Properties to be taken for the InteEceptor Sewer <br />Froject <br /> (Continued Open from 8-29-78) <br /> Mr. Levine reviewed his report dated August 23, 1978, regarding this matter. <br /> <br /> Mayor Mercer declared the continued public hearing open. <br /> <br /> Mr. Irving Loube, Attorney representing the Fromm property owners, stated <br />his client supports the project and does not object to the property acquisition. <br /> <br /> There being no further public testimony, Mayor Mercer declared the public <br />hearing closed. <br /> <br /> It was moved by Councilmember Wood, and seconded by Councilmember Brandes, <br />that Resolution No. 78-225, a Resolution of Necessity to acquire two parcels <br />on Parcel No. 946-3630-1-2 o~med by Catholic Bishop of Oakland; the parcels <br />consist of a 10' wide permanent sewer easement and a 20' wide construction <br />easement; the permanent easement contains 0.11+__acre and the temporary con- <br />struction easement is 0.33~, be adopted. <br />The roll call vote was as follows: <br />AYES: Councilmen Brandes, Butler, Wood, and Mayor Mercer <br />NOES: None <br />ABSENT: Councilman Kephart, <br /> <br /> It was moved by Councilmember Brandes, and seconded by Councilmember Butler, <br />that Resolution No. 78-226, a Resolution of Necessity to acquire two parcels <br />from several parcels owned by the City and County of San Francisco; the parcels <br />consist of a 10' wide permanent sewer easement and a 20' wide construction ease- <br />ment; the permanent easement contains 0.59lacre and the temporary construction <br />easement contains 0.93+ acre, be adopted. <br />The roll call vote was as follows: <br />AYES: Councilmen Brandes, Butler, Wood, and Mayor Mercer <br />NOES: None <br />ABSENT: Councilman Kephart <br /> <br /> <br />
