Councilmember Brandes asked representatives of Tam Investment Company if they <br />would be willing to tear down the wooden fence at the time they constructed the <br />masoneryfence. They indicated they would do so if it was desired by the homeowners. <br /> <br /> There being no further public testimony, Mayor Mercer declared the public hear- <br />ing closed. <br /> <br /> Councilmember Brandes stated he was opposed to the latest commercial develop- <br />ment plan because he felt there was too much mass for the area. He presented <br />background information on the subject property and stated that many of the pre- <br />vious mitigating measures had been met but he still had concerns about the buffer <br />requirements on the "P" site, left hand turn off Hopyard Road, back-up lanes, too <br />much building on the property, usage on the P&I site, and landscaping on the "P" <br />site. <br /> <br /> The City Attorney read the list of conditional uses allowed on a Public and <br />Institutional site. <br /> <br /> Councilmember Butler stated he felt there was no misuse on the subject "P" <br />site. <br /> <br /> After discussion, it was moved by Councilmember Wood, and seconded by Council- <br />member Butler, that Resolution No. 78-200, approving the design review of the Tam <br />Investment project on Valley Avenue at Hopyard Road with the condition that the <br />masonery wall, landscaping and sprinkler be installed immediately, and that the <br />Landscape Agreement be modified to cover regular discing of the P&I site, be <br />adopted. <br />The roll call vote was as follows: <br />AYES: Councilmen Butler, Kephart, Wood, and }~yor Mercer <br />NOES: Council~n Brandes <br />ABSEnt: None <br /> <br /> It ~as moved by Councilmember Brandes, and seconded by Mayor Mercer, that the <br />Conditional Use Permit for Tam Investment Company project be denied and that the <br />parking spaces not be allowed on the "P" site. <br />The roll call vote was as follows: <br />AYES: Councilman Brandes and Mayor Mercer <br />NOES: Councilmen Butler, Kephart, and Wood <br />ABSENT: None <br /> <br /> It was moved by Councilmember Butler, and seconded by Councilmember Kephart, <br />that Resolution No. 78-201, approving the application of Tam Investment Company <br />with conditions, approving the use of a small portion of the 1.8 acre P (Public <br />and Institutional) zoned property located on the north side of Valley Avenue <br />approximately 400' east of Hopyard Road for the parking of automobiles in con- <br />junction with a shopping center proposed to be located ~ediately west of the <br />subject site, and with the modification that a condition be added prohibiting <br />the use of tha P&I portion of the site for construction yard use during construc- <br />tion of the "C" site area, be adopted. <br />The roll call vote was as follows: <br />AYES: Councilmen Butler, Kephart, Wood, and Mayor Mercer <br />}~OES: Councilman Brandes <br />ABSF21T: None <br /> <br /> 5. 8/8/78 <br /> <br /> <br />
