Application of L & H Land Company for approval of a hillside planned development <br />consisting of a 10-lot,. s~ngle-family residential subdivision located on a 50 <br />acre site northwesterly of the existing terminus of Longview Drive. The site is <br />zoned HPD (Hillside Planned Development) District. An Environmental Impact Re- <br />port (EIR) will also be considered <br />(Continued Open from 4-10-79) <br /> Mr. Harris presented his report dated April 3, 1979, regarding this matter. <br /> <br /> Mayor Brandes declared the continued public hearing open on the application <br />and the Environmental Impact Report. <br /> <br /> Mr. Gil ~ines, Attorney, 39465 Paseo Padre Parkway, Fremont, representing <br />the applicant, stated his client concurred with the Planning Commission recommen- <br />dation for approval, and disagreed with staff that further geologic studies be <br />required to determine the stability of the subject site. Mr. Maines discussed <br />in detail concerns of the City regarding geology, fire hazards, and liability of <br />the City. Mr. Maines and Council and Fire Chief Hill reviewed each of the 35 <br />conditions, as modified by staff, attached to PUD-78-1, and made various sug- <br />gested changes. <br /> <br /> The following persons spoke in opposition to the application and the Environ- <br />mental Impact Report: <br /> <br /> George Bing, Livermore, representin the Livermore-Amador Valley Sierra <br /> Club <br /> Margaret Tracy, Livermore, representing Preserve Area Ridgelands Com- <br /> mittee <br /> <br /> There being no further testimony, Mayor Brandes declared the public hearing <br />closed on the application and the Environmental Impact Report. <br /> <br /> After discussion, it was moved by Councilmember Wood, and seconded by Council- <br />member Butler, that Resolution No. 79-72, after review of the findings with regard <br />to the Environmental Impact Report as set forth in Planning Commission Resolution <br />No. 1726, make the finding that the Environmental Impact Report prepared for the <br />L & H Land Group is complete and sufficient and acceptable for the project filed <br />under PUD-78-1, and that conditions to the proposal, particularly Conditions 33-35 <br />will significantly mitigate geologic hazards on the site, be adopted. <br />The roll call vote is as follows: <br />AYES: Councilmen Butler, Wood, and Mayor Brandes <br />NOES: Councilmen Kephart and Mercer <br />ABSEnt: None <br /> <br /> With regard to the conditions attached to PUD-78-t, Council took the following <br />actions: <br /> <br />Condition 14. That the proposed roadway shall have a width of not less than 24 ft. <br />of paved surface capable of being utilized by emergency vehicles with normal traffic <br />lanes being a minimum of 20 ft. in width; that it shall have a minimum overhead <br />clearance of 13 ft. 6 in., this clearance to be maintained for the full 24 ft. <br />width of the roadway; that it shall have no more than a 20% grade; that every <br />reasonable effort shall be made to keep length of 20% grade sections to a minimum; <br />and that the road shall be engineered in a manner that allows for the safe ingress <br />and egress of emergency apparatus utilized by the City as determined by the Fire <br />Chief and City Engineer. <br /> <br /> 11. 4/24/79 <br /> & <br /> <br /> <br />
