Mrs. Charlotte Severin, 4513 Mirador Drive, representing the Pleasanton Heights <br />homeowners, stated they would like to have the wording changed in the body of the <br />agreement from "to a height not extending above a horizontal plane four (4) feet <br />above the level of the rear yard" to read "to a height at the same level of the rear <br />yard". Mrs. Severin also requested that Condition 5 of Ordinance No. 914 - That all <br />perimeter fencing, especially the fencing along Pico Avenue, shall be approved by the <br />Planning Commission prior to final map approval, there shall be no fencing higher <br />than 4 feet on the property lines adjacent to the properties abutting on Angela <br />Street and Mirador Drive; be deleted. She stated that Centex Homes agreed to this. <br /> <br /> After discussion, it was moved by Councilmember Mercer, and seconded by Council- <br />member Kephart, that Ordinance No. 914, to rezone a 32 acre site located between <br />Pleasanton School Upper Playfield and Miradot Drive immediately southerly of the <br />residences bordering Angela Street (Centex Homes), from the A (Agricultural) District <br />to the PUD (Planned Unit Development) District and for development plan approval for <br />a 79 lot, single-family residential subdivision, subject to conditions, and amending <br />the Zoning Map of the City of Pleasanton accordingly, and deleting Condition 5, be <br />adopted. <br />The roll call vote was as follows: <br />AYES: Councilmen Kephart and Mercer <br />NOES: Councilmen Butler, Wood, and Mayor Brandes <br />ABSENT: None <br /> <br /> After further discussion, it was moved by Councilmember Mercer, and seconded by <br />Councilmember Butler, that Ordinance No. 914, to rezone a 32 acre site located be- <br />tween Pleasanton School Upper Playfield and Mirador Drive immediately southerly of <br />the residences bordering Angela Street (Centex Homes), from the A (Agricultural) <br />District to the PUD (Planned Unit Development) District and for development plan <br />approval for a 79 lot, single-family residential subdivision, subject to all condi- <br />tions, and amending the Zoning Map of the City of Pleasanton accordingly, be adopted <br />as introduced. <br />The roll call vote was as follows: <br />AYES: Councilmen Butler, Kephart, and Mercer <br />NOES: Councilman Wood and Mayor Brandes <br />ABSENT: None <br /> <br /> The City Attorney read modified language to the Model View Easement as follows: <br />"to a height not extending above a horizontal plane level with the rear yard as that <br />yard now exists at the boundary lines of the property hereinabove described except <br />that the owners of the servient property may construct a four (4) foot fence if <br />approved by grantee in writing". <br /> <br /> It was moved by Councilmember Mercer, and seconded by Councilmember Kephart, <br />that the Model View Easement related to Centex Homes PUD-79-11 be approved as <br />modified. <br />The roll call vote was as follows: <br />AYES:-~ Councilmen Kephart, Mercer, and Wood <br />NOES: Councilman Butler and Mayor Brandes <br />ABSENT: None <br /> <br />SPECIAL REPORTS <br /> There were no Special Reports presented at this meeting. <br /> <br />REPORTS OF BOARDS AND COMMISSIONS <br /> There were no reports of Boards and Commissions presented at this meeting. <br /> <br /> 13. 11/13/79 <br /> <br /> <br />
