PUBLIC HEARINGS <br />Application of Ernest Pestaria to prezone a 35 acre site located between the Rose- <br />pointe subdivision and Happy Valley Road, .immediately westerly of Amber Lane, to <br />the R7~,20~000 (Single.-Fam.ily Resideptial) Dis.t~ict or pny other district consis- <br />tent with the General Plan <br /> <br />On the basis of an Initial Study of the potential environmental impacts of the <br />prg~ect, ~he Director of Planning an~ .C.ommun.ity Development has determined that <br />the pFoposed project would not have any p~tential significant adverse effects on <br />the environment and that an environmental impact report need not be prepared. <br />This .Initial .Study is available for review at the Plannin~ DiviSion~ 200 .Bernal <br />Avenue, Pleasanton. Comments on this decision may be directed to either the <br />Planning staff prior to the above meeting d~e~ or direqtl~ to the City Council <br />at the above noticed meetin~ <br /> Mr. Harris presented his report dated August 9, 1979, regarding this matter. <br /> <br /> Mayor Brandes stated that all correspondence, petitions, Planning Commission <br />reports and Minutes, received regarding this item would become a part of the re- <br />cord relative to this matter. <br /> <br /> Mayor Brandes declared the public hearing open of the application and the <br />Negative Declaration. <br /> <br /> Mr. Ted Fairfield, Civil Engineer representing the applicant, presented a <br />detailed review of the proposed development, and stated it conformed with all <br />criteria. Mr. Fairfield offered the following additional comments: that Mr. <br />Pestana had owned the land for more than ten years and should be allowed to <br />develop it; that the proposed density was lower than Rosepointe and lower than <br />established by the General Plan; that there is a need for this type of custom <br />housing in Pleasanton; that development would be gradual and phased over a six <br />year period; that lots would be left on natural grade as much as possible; trees <br />would be preserved; the creek preserved; there would be rolled curbs and special <br />street lighting; and that ingress and egress to the development would be designed <br />so as to cause the least impact on the surrounding area. He stated that Arlington <br />Drive had been built as a collector street and would be used for that. Mr. Fair- <br />field stated he had met with representatives of residents in Rosepointe to offer <br />a compromise solution to the concerns of these people, as follows: the developer <br />agrees to build an entry structure to divide the road on the street coming off <br />Happy Valley Road so that through traffic would not be encouraged to come through <br />Rosepointe to Sunol; to put in a Stop sign at the appropriate spot to impede the <br />flow of through traffic; to take additional means to slow traffic on Arlington <br />Drive; to install a heavy planting strip of speciman trees and shrubs between the <br />Pestana property and Rosepointe; and to cooperate with the residents to request <br />that the City use park dedication fees for development of a mini-park. <br /> <br /> Mayor Brandes stated it need to be understood by the Rosepointe residents that <br />these compromise items will not be considered by the Council in making a decision <br />on this item and that any agreement between Pestana and them is not binding on the <br />City. <br /> <br /> Mr. Fairfield stated these compromise items were offered as good faith efforts <br />in an effort to alleviate the concerns of the Rosepointe residents. <br /> <br /> 3. 9/11/79 <br /> <br /> <br />
