Tam Investmen~...Company The City Attorney presented his Information Report dated July 24, 1979, re- garding Tam Investment Companyts letter to homeowners on Longspur requesting that the residents execute a release, waiving their rights for any damage claims for injuries caused by the application of an "oil emulsion" on the Tam property to provide dust control. He stated that the developer no longer intends to use the oil emulsion mentioned in the release for dust control, and that normal control measures will be used (water spraying). Pearson vs. City of Pleasanton The City Attorney presented his report dated July 24, 1979, regarding this matter, stating the hearing on the petition should be heard early in August in the Superior Court in Hayward and the defense of the matter should be handled "in house", ! . Mayor Brandes presented a letter from the Chamber of Commerce dated July 23, !~,~,~ 1979, requesting the City to consider assisting in the funding of a color brochure regarding information about the City of Pleasanton; cost estimates being approxi- mately $3,500.00 for 30,000 brochures. After discussion, it was moved by Councilmember Mercer, and seconded by Councilmember Butler, that Resolution No. 79-127, authorizing an expenditure of up to $1,750.00 to assist the Chamber of Commerce in the production of a color bro- chure containing information regarding the City of Pleasanton, be adopted. The roll call vote was as follows: -~ AYES: Councilmen Butler, Kephart, Mercer, and Mayor Brandes NOES: None ABSENT: Councilman Wood CITY COUNCIL CALENDAR Mr. Brown presented the Calendar for the information of the Council. Mr. Brown advised there would be an Adjourned Regular City Council meeting August 1, 1979, 7:30 P.M., Fairgrounds Cafeteria, to discuss Residential Alloca- tion Program changes. After discussion, Council determined to cancel the Regular City Council. meeting of August 14, 1979. EXECUTIVE SESSION Mayor Brandes recessed the meeting at 12:30 A.M., to an Executive Session to discuss pending litigation. Mayor Brandes reconvened the meeting at 1:00 A.M. It was moved by Councilmember Butler, and seconded by Councilmember Mercer, that Resolution No. 79-128, authorizing the City Manager to retain a consultant and enter into an agreement to prepare an Environmental Impact Report on the truck weight limitation ordinance, be adopted.
