Tam Investmen~...Company <br /> The City Attorney presented his Information Report dated July 24, 1979, re- <br /> garding Tam Investment Companyts letter to homeowners on Longspur requesting that <br /> the residents execute a release, waiving their rights for any damage claims for <br /> injuries caused by the application of an "oil emulsion" on the Tam property to <br /> provide dust control. He stated that the developer no longer intends to use the <br /> oil emulsion mentioned in the release for dust control, and that normal control <br /> measures will be used (water spraying). <br /> <br /> Pearson vs. City of Pleasanton <br /> The City Attorney presented his report dated July 24, 1979, regarding this <br /> matter, stating the hearing on the petition should be heard early in August in <br /> the Superior Court in Hayward and the defense of the matter should be handled "in <br /> house", <br /> <br />! . Mayor Brandes presented a letter from the Chamber of Commerce dated July 23, <br />!~,~,~ 1979, requesting the City to consider assisting in the funding of a color brochure <br /> regarding information about the City of Pleasanton; cost estimates being approxi- <br /> mately $3,500.00 for 30,000 brochures. <br /> <br /> After discussion, it was moved by Councilmember Mercer, and seconded by <br /> Councilmember Butler, that Resolution No. 79-127, authorizing an expenditure of up <br /> to $1,750.00 to assist the Chamber of Commerce in the production of a color bro- <br /> chure containing information regarding the City of Pleasanton, be adopted. <br /> The roll call vote was as follows: <br /> -~ AYES: Councilmen Butler, Kephart, Mercer, and Mayor Brandes <br /> NOES: None <br /> ABSENT: Councilman Wood <br /> <br /> CITY COUNCIL CALENDAR <br /> Mr. Brown presented the Calendar for the information of the Council. <br /> <br /> Mr. Brown advised there would be an Adjourned Regular City Council meeting <br /> August 1, 1979, 7:30 P.M., Fairgrounds Cafeteria, to discuss Residential Alloca- <br /> tion Program changes. <br /> <br /> After discussion, Council determined to cancel the Regular City Council. <br /> meeting of August 14, 1979. <br /> <br /> EXECUTIVE SESSION <br /> Mayor Brandes recessed the meeting at 12:30 A.M., to an Executive Session <br /> to discuss pending litigation. <br /> <br /> Mayor Brandes reconvened the meeting at 1:00 A.M. <br /> <br /> It was moved by Councilmember Butler, and seconded by Councilmember Mercer, <br /> that Resolution No. 79-128, authorizing the City Manager to retain a consultant <br /> and enter into an agreement to prepare an Environmental Impact Report on the <br /> truck weight limitation ordinance, be adopted. <br /> The roll call vote was as follows: <br /> AYES: Councilmen Butler, Kephart, Mercer, and Mayor Brandes <br /> NOES: None <br /> ABSENT: Councilman Wood <br /> <br /> 17. 7/24/79. <br /> <br /> <br />
