Comments on this dec~si.qn ~ay be directed to either the Plan- <br />ning staff prior to the above meeting dat. e, o.r _directly to the City Council at the <br />above' noticed meetin~ <br /> Mr. Harris presented his report dated June 29, 1979, regarding this matter. <br /> <br /> Mayor Brandes declared the public hearing open on the application and the <br />Negative Declaration. <br /> <br /> Mr. Ted Fairfield, 1811 Santa Rita Road, representing DeWitt Wilson, gave <br />background information regarding the property and stated he concurred with the <br />staff report with the exception of Condition 8 of Planning Commission Resolution <br />No. 1756, regarding homeowners maintenance of all private streets and utilities. <br />He requested the language be changed to make it clear that the homeowners were <br />not responsible for maintenance of City utilities. Council concurred. The City <br />Attorney recommended that the wording "exclusiveof public utilities" be added to <br />Condition 8. <br /> <br /> No one in the audience spoke in opposition to this application and Negative <br />Declaration. <br /> <br /> There being no further testimony, Mayor Brandes declared the public hearing <br />closed on the application and Negative Declaration. <br /> <br /> It was moved by Councilmember Butler, and seconded by Councilmember Wood, that <br />Resolution No. 79-111, determining on the basis of a review of initial environ- <br />mental study done for this project, that no significant environmental impact would <br />occur as outlined in the City's guidelines and that a Negative Declaration is <br />appropriate to rezone a 4.9 acre site located along the south side of Junipero <br />Street between Sunol Boulevard and Sonoma Drive from the P~1-4000 (Multiple- <br />Residential) and "S" (Study) Districts to the PUD (Planned Unit Development) Dis- <br />trict and for approval of a development plan for a 40-unit garden court type <br />single family residential complex on the site, be adopted. <br />The roll call vote was as follows: <br />AYES: Councilmen Butler, Kephart, Wood, and b'~yor Mercer <br />NOES: None <br />ABSENT: Councilman Mercer <br /> <br /> It was moved by Councilmember Wood, and seconded by Councilmember Butler, <br />that Ordinance No. 895, to be read by title only and waiving further reading <br />thereof, to rezone a 4.9 acre site located along the south side of Junipero Street <br />between Sunol Boulevard and Sonoma Drive from the RM-4000 (Multiple-Residential) <br />and "S" (Study) Districts to the PUD (Planned Unit Development) District and for <br />approval of a development plan for a 40-unit garden court type single family <br /> <br /> 5. 7/10/79 <br /> <br /> <br />
