211 <br /> <br /> Mr. Keith Fraser, Attorney representing Robert E. Frank, stated he concurred <br />with the staff report. He stated there were objections to this proposed project <br />but he felt that there is adequate protection for the neighborhood. He requested <br />Council to affirm the Planning Commission recommendation for approval. <br /> <br /> Mr. Bill Christensen, 7979 Hillsboro Court, President of the Stoneridge Home- <br />owners Association, expressed opposition to the application because of adverse im- <br />pacts the proposed project would create. He stated he feels this parcel is best <br />suited for limited retail businesses and to allow any other retail business such <br />as originally proposed would be bad. He stated that restaurants and bars would <br />change the nature of the residential area surrounding the property. He further <br />stated that 90% of the access will have to be from Pleasant Hill Drive, a residen- <br />tial street. He stated there would be traffic through the housing development to <br />get to this retail center and he did not want to see any more traffic generated <br />than there is now. He added that anyone coming to the center from Stoneridge would <br />have to make a left-turn to the property. Mr. Christensen referred to an agreement <br />made last year concerning the BART property north of Stoneridge Drive relating to <br />traffic studies and that a 'no left turn g would be placed at this intersection <br /> sin' <br />limiting access to and from Pleasant Hill Road. He stated the homeowners were <br />assured their development would be protected against the BART traffic created in <br />this area at all costs and that retail uses would be kept within the shopping center <br />property. He stated there would also be curb cuts on both sides of Pleasant Hill <br />Road. Mr. Christensen concluded by stating he would like to property to be zoned <br />Office or a more realistic use of the commercial PUD such as pharmacies, real <br />estate office; any low traffic business with limited hours of operation. He re- <br />quested Council to continue this item for further review of the uses to be allowed <br />in the proposed project. <br /> <br /> Mr. Yvan Albert, 7926 Hillsboro Court, addressed traffic concernson Pleasant <br />Hill. He stated that Pleasant Hill is a deadend street and is not a major inter- <br />section which could accommodate retail uses. He stated the applicant would have <br />to have a greater trade area than Highland Oaks and Stoneridge and would have to <br />draw from all over the community. He also stated that if this development is <br />allowed to take place there would be retail stores within 90 yards of residential <br />housing. <br /> <br /> Mr. Fraser rebutted by referring to the comments of the Director of Planning at <br />the Planning Commission meeting recommending that the subject property be rezoned <br />to PUD-Commercial with consideration being given to the allowed and conditionally <br />allowed uses. <br /> <br /> There being no further testimony, Mayor Mercer declared the public hearing <br />closed on the application and the negative declaration. <br /> <br /> It was moved by Councilmember Butler, and seconded by Councilmember Wood, that <br />Resolution No. 80-275, determining on the basis of a review of initial environ- <br />mental study done for this project, that no significant environmental impact would <br />occur as outlined in the City~s guidelines and that a Negative Declaration is <br />appropriate to rezone from the C-F (Commercial Freeway) District to the PUD-Commer- <br />cial District the 2.54+ acre site located at the southeast corner of Foothill Road <br />and Stoneridge Drive, be adopted. <br />The roll call vote was as follows: <br />AYES: Councilmembers Butler, Mohr, Wood, and Mayor Mercer <br />NOES: None <br />ABSENT: Councilmember Kephart <br /> <br /> 4. 10/28/80 <br /> <br /> <br />
