REPORTS OF THE CITY ATTORNEY <br />Ordinance Amendin~ Section 2-20.08(c)(3) of the RAP Ordinance to set 250 units per <br />year to be phased <br /> Mr. Levine presented a proposed ordinance relative to this matter. <br /> <br /> It was moved by Councilmember Butler, and seconded by Councilmember Mohr, that <br />Ordinance No. 944, to be read by title only and waiving further reading thereof, <br />amending Title II, Chapter 13, Section 2-20.08(c)(3) (Phased Projects) of the Resi- <br />dential Allocation Program by modifying the said section increasing the number of <br />units in a multi-year project to a maximum of 250, be introduced. <br />The roll call vote was as follows: <br />AYES: Councilmembers Butler, Kephart, Mohr, Wood, and Mayor Mercer <br />NOES: None <br />ABSENT: None <br /> <br />Ordinance Amendin~ Section 2-20.08(b) relatin~ to size of projects <br /> Mr. Levine presented a proposed ordinance relative to this matter. <br /> <br /> Mr. Jim Price, developer, stated he was concerned about the limitations this <br />proposed ordinance might create, and felt some arrangement should be provided to <br />allow small developers special points so they could be more competitive with the <br />large developers. <br /> <br /> It was moved by Councilmember Butler, and seconded by Mayor Mercer, that Ordi- <br />nance No. 945, be read by title only and waive further reading thereof. <br />The roll call vote was as follows: <br />AYES: Councilmembers Butler, Kephart, Mohr, Wood, and Mayor Mercer <br />NOES: None <br />ABSENT: None <br /> <br /> It was moved by Councilmember Butler, and seconded by Councilmember Kephart, <br />that Ordinance No. 945, amending Title II, Chapter 13, Section 2-20.08(b) (Size of <br />Projects) of the Residential Allocation Program by modifying the number of units <br />permitted for a non-phased project in a given year, be introduced. <br />The roll call vote was as follows: <br />AYES: Councilmembers Butler, Kephart, Wood, and Mayor Mercer <br />NOES: Councilmember Mohr <br />ABSENT: None <br /> <br />Proposed Noise-Ordinance <br /> Mr. Dantche presented his report dated September 18, 1980, regarding this matter. <br /> <br /> Mr. Frank C. Brandes, Jr., 6889 Corte Sonada, stated he felt the ordinance is <br />needed but questioned its application and enforcement, especially as related to non- <br />muffled motorcycles and gravel trucks on First Street. <br /> <br /> The City Attorney pointed out that this ordinance does not address vehicle noise, <br />which is already covered by State law. <br /> <br /> After discussion, it was moved by Councilmember Wood, and seconded by Council- <br />member Kephart, that Ordinance No. 946, to be read by title only and waiving further <br />reading thereof, amending Title IV by adding Chapter 9 (Noise Regulation) and amend- <br />ing Title I, Chapter 1, Section 1-1.15 making violations of each chapter on infrac- <br />tions, with draft ordinance in its exemption section Activities of City Parks <br />approved by the appropriate officials, be introduced. <br />The roll call vote was as follows: <br />AYES: Councilmembers Butler, Kephart, Mohr, Wood, and Mayor Mercer <br />NOES: None <br />ABSEh~: None <br /> 9. 9/23/80 <br /> <br /> <br />
