It was moved by Councilmember Kephart, and seconded by Councilmember Butler, <br /> that Resolution No. 80-236, denying the Claim against the City by Stanley Janes <br /> and referring the matter to the City Attorney's office for handling, be adopted. <br /> The roll call vote was as follows: <br /> AYES: Councilmembers Butler, Kephart, Mohr, and Mayor Mercer <br /> NOES: None <br /> ABSENT: Councilmember Wood <br /> <br /> Acceptance of Improvements for Tract 4119~vin. tage Hills <br /> Mr. Levine presented his report dated September 15, 1980, regarding this matter. <br /> <br /> · It was moved by Councilmember Butler, and seconded by Councilmember Kephart, that <br /> Resolution No. 80-237, accepting the improvements for Tract 4119, Vintage Hills, be <br /> adopted. <br /> The roll call vote was as fq.!!ow~.: <br /> AYES: Coun'cil~embers Butler, Kephart, Mohr, and Mayor Mercer <br /> NOES: None <br /> ABSENT: Councilmember Wood <br /> <br /> COMMUNICATIONS <br /> Mayor Mercer presented a petition, signed by 23 residents on Heatherlark Circle, <br /> which reas as follows: "Please take notice that each of the signaturees below hereby <br /> demands that the public lighting fixtures in evidence on Heatherlark Circle, Pleasan- <br /> ton, County of Alameda, hereby be re-activated. This action shall not require any <br /> further expense to either the City of Pleasanton nor the taxpayers hereby requesting <br /> such action if a lighting fixture in the Heatherlark Tot-Lot is turned off and a <br /> street fixture substituted for same. Should further action be required, the under- <br /> signed shall proceed with all legal remedies available to us as registered voters, <br /> taxpayers and/or citizens." · <br /> <br /> The City Manager advised that there were no unusual circumstances at this loca- <br /> tion to cause deviation from the City's street lighting policy. <br /> <br /> After discussion, Council instructed staff to advise the residents on Heatherlark <br /> Circle that the City would not activate the street lights as requested by them in <br /> their petition. <br /> <br /> CITY COUNCIL CALENDAR <br /> Mr. Walker presented the Calendar for the information of the Council. <br /> <br /> EXECUTIVE SESSION <br /> b~yor Mercer recessed the meeting at 11:30 P.M., to an Executive Session to <br /> discuss labor relations. <br /> <br /> Mayor Mercer reconvened the meeting at 12:30 A.M. <br /> <br />ADJOURNMENT <br /> There being no further business at 12:35 A.M., it was moved by Councilmember <br />Kephart, and seconded by Councilmember Mohr, that the meeting be adjourned to meet <br />again in Regular Session on September 23, 1980, 8:00 P.M., at the Fairgrounds <br />Cafeteria. <br /> <br />Respectfully submitted, <br /> <br />S R.
