It was moved by Councilmember Kephart, and seconded by Councilmember Butler, that Resolution No. 80-236, denying the Claim against the City by Stanley Janes and referring the matter to the City Attorney's office for handling, be adopted. The roll call vote was as follows: AYES: Councilmembers Butler, Kephart, Mohr, and Mayor Mercer NOES: None ABSENT: Councilmember Wood Acceptance of Improvements for Tract 4119~vin. tage Hills Mr. Levine presented his report dated September 15, 1980, regarding this matter. · It was moved by Councilmember Butler, and seconded by Councilmember Kephart, that Resolution No. 80-237, accepting the improvements for Tract 4119, Vintage Hills, be adopted. The roll call vote was as fq.!!ow~.: AYES: Coun'cil~embers Butler, Kephart, Mohr, and Mayor Mercer NOES: None ABSENT: Councilmember Wood COMMUNICATIONS Mayor Mercer presented a petition, signed by 23 residents on Heatherlark Circle, which reas as follows: "Please take notice that each of the signaturees below hereby demands that the public lighting fixtures in evidence on Heatherlark Circle, Pleasan- ton, County of Alameda, hereby be re-activated. This action shall not require any further expense to either the City of Pleasanton nor the taxpayers hereby requesting such action if a lighting fixture in the Heatherlark Tot-Lot is turned off and a street fixture substituted for same. Should further action be required, the under- signed shall proceed with all legal remedies available to us as registered voters, taxpayers and/or citizens." · The City Manager advised that there were no unusual circumstances at this loca- tion to cause deviation from the City's street lighting policy. After discussion, Council instructed staff to advise the residents on Heatherlark Circle that the City would not activate the street lights as requested by them in their petition. CITY COUNCIL CALENDAR Mr. Walker presented the Calendar for the information of the Council. EXECUTIVE SESSION b~yor Mercer recessed the meeting at 11:30 P.M., to an Executive Session to discuss labor relations. Mayor Mercer reconvened the meeting at 12:30 A.M. ADJOURNMENT There being no further business at 12:35 A.M., it was moved by Councilmember Kephart, and seconded by Councilmember Mohr, that the meeting be adjourned to meet again in Regular Session on September 23, 1980, 8:00 P.M., at the Fairgrounds Cafeteria.
