It was moved by Councilmember Butler, and seconded by Councilmember Mohr, that <br />Resolution No. 80-218, determining on the basis of a review of initial environmental <br />study done for this project, that no significant environmental impact would occur as <br />outlined in the City's guidelines and that a Negative Declaration is appropriate to <br />rezone from the R-1-6500 (Single-Family Residential) District to the PUD (Planned Unit <br />Development) District a 4.4 acre site located on the east side of Fairlands Drive <br />~r~nediately north of West Las Positas Boulevard, and for development plan approval <br />for a 35-unit condominium complex proposed to be built at this location, be adopted. <br />The roll call vote wasas follows: <br />AYES: Councilmembers Butler, Kephart, Mohr, Wood, and Mayor Mercer <br />NOES: None <br />ABSENT: None <br /> <br /> It was moved by Councilmember Wood, and seconded by Councilmember Butler, that <br />Ordinance No. 940, to be read by title only and waiving further reading thereof, <br />approving the application of Dennan Construction Company to rezone from the R-1-6500 <br />(Single-Family Residential) District to the PUD (Planned Unit Development) District <br />a 4.4 acre site located on the east side of Fairlands Drive immediately north of <br />West Las Positas Boulevard and development plan for a 35-unit condominium complex <br />proposed to be built at this location subject to all of the conditions of Planning <br />Commission Resolution No. 1898, be introduced. <br />The roll call vote was as follows: <br />AYES: Councilmembers Butler, Kephart, Mohr, Wood, and Mayor Mercer <br />NOES: None <br />ABSENT: None <br /> <br />Application of James Price Development Compan~ to fezone from RM-4000 (Multiple- <br />Residential) District to the PUD (Planned Unit Development) District a 3.2 acre <br />site located on the north side of Black Avenue between' Harvest Road and Crestline <br />Road. This application also includes a request for developmep~.pian ~pprovalfor <br />a 34-unit condominium complex proposed to be built at this location <br /> <br />On the basis of an Initia! Study of the potential environmental impacts of the <br />project, the Director of Planning and Community Development has determined that <br />the. proposed project would not have any potential significant adverse effects on <br />the environment and that an environmental impact report need not be prepared. <br />This Initial Study is available for review at the Planning Division, 200 Bernal <br />Avenue, Pleasanton. Comments on this decisi.gn may be directed to either the <br />Plannin~ staff prior to the above meeting date, or directly to the City Council <br />at the above noticed meeting <br /> Mr. Harris presented his report dated August 15, 1980, regarding this matter. <br /> <br /> Councilmember Wood stated he had concerns regarding the condition of the present <br />fence and trees at the rear of this property and felt a new fence should be con- <br />structed like the one on the other side of the property development, and that this <br />should be added as a condition. <br /> <br /> Councilmember Kephart stated he also had concerns about control of dust. Mayor <br />Mercer concurred and stated he felt this should be added as a condition to approval <br />of the application. <br /> <br /> Mayor Mercer declared the public hearing open on the application and the negative <br />declaration. <br /> <br /> 4. 8/26/80 <br /> <br /> <br />
