It was moved by Councilmember Butler, and seconded by Councilmember Mohr, that Resolution No. 80-111, authorizing the City Attorney to formally request Alameda County to provide defense in the case of Sears, Roebuck & Company, a Corporation, v. County of Alameda, City of Hayward, City of Oakland, City of Fremont, City of Livermore, City of Union City, City of Pleasanton, City of San Leandro, Does I through X, inclusive, be adopted. The roll call vote was as follows: AYES: Councilmembers Butler, Mohr, and Mayor Mercer NOES: None ABSENT: Councilmembers Kephart and Wood Report on Condominium Conversions Mayor Mercer declared this item continued to the meeting of May 13, 1980, for full Council attendance. Mr. Levine stated that if Councilmembers had any suggestions or changes they desired to see made in the draft ordinance to advise him before the May 13 meeting. Councilmember Butler requested that a clause be added to insure that the tenter had the first right to purchase. COMMUNICATIONS Letter from ~lamed.e' County Mosquito Abatement District Mayor Mercer presented a letter from the Alameda County Mosquito Abatement Dis- trict dated April 4, 1980, advising that the District funding has been reduced by 40%, however, the District has continued to provide control of species of mosquitos that are considered to be of highest priority to control, and will continue to pro- vide the most effective control possible for existing level of funding. CITY COUNCIL CALENDAR Mr. Walker presented the Calendar for the information of the Council. Mayor Mercer requested that the City Council Calendar be retyped to reflect the new liaison assignments. Mayor Mercer advised that on April 27th, 1980, McDonald's Corporation would be sponsoring '~McHappy Day" with a portion of the proceeds donated to "Special Olym- pics" and that elected officials were requested to work as a contribution to this project. He urged Councilmembers to participate if their schedules permitted. Mr. Walker advised that the Final Environmental Impact Report for the Gravel Truck Ordinance would not be completed in time for the public hearing meeting scheduled on April 29th, therefore this meeting should be cancelled. He stated he would discuss another date with Council when it could be determined when this report would be complete. Councilmember Butler advised he would be absent from the May 13th meeting. Council discussion ensued relative to a time to interview Planning Commission candidates. Council tentatively scheduled April 30, 1980, beginning at 7:30 P.M., at the City Hall Conference Room, subject to the attendance of Councilmembers Kephart and Wood. 10. 4/22/ao
