Mr. <br />Levine advised that the City had met with representatives of Southwest Nuclear <br />Company to discuss the terms of the agreement which would require Southwest Nuclear <br />Company to: (1) eliminate its entire inventory at 7055A Commerce Circle and cease <br />use of that site as soon as possible, but in any case not more than 30 days from <br />the date of this agreement; (2) to eliminate its inventory at 7066A Commerce Circle <br />in excess of the permitted 1500 to 2000 cubic feet, or the equivalent of one 40-foot <br />trailer van load, immediately but in no case more than30 days from the date of this <br />agreement; (3) Company will not bring any additional materials onto either site until <br />the use of 7055A Commerce Circle has been completely eliminated and the inventory at <br />7066A Commerce Circle has been reduced to the amount specified in its Fire Department <br />permit; (4) Company agrees to cooperate fully with the City of Pleasanton in permit- <br />ting a monitoring program to insure compliance with this agreement and the existing <br />zoning and fire permits; (5) should Company be found to be in violation of any of <br />its City permits or of any agreement made herein, Company by and through its corpor- <br />ate officers, acknowledges and accedes to the revocation of its zoning permit and <br />fire permit and agrees to vacate its facility at 7066A Commerce Circle within a <br />reasonable time thereafter, but not to exceed 60 days; and that the City agrees not <br />to file criminal or civil abatement actions against Company for its existing viola- <br />tions at 7055A and 7066A Commerce Circle so long as Company moves expeditiously to <br />correct said actions and complies in all matters with this agreement. <br /> <br /> Mr. Levine stated that Southwest Nuclear Company concurred to the terms of the <br />agreement with the exception of the 30 day period for compliance; Southwest Nuclear <br />Company requested this period be for 45 days. <br /> <br /> Mr. William Hir~' Attorney representing Southwest Nuclear Company, stated that <br />negotiations were underway with the State of Washington for use of the dump site <br />there and the extension of the compliance period would allow completion of this <br />contrac~ aed allow Southwest Nuclear to bring their firm into compliance with City <br />regulations. He stated that Southwest Nuclear Company is in compliance with State <br />radiation regulations and that there.is no danger to the health, saferye. and wel- <br />fare of the operation of this firm. <br /> <br /> 2. 2/11/80 <br /> <br /> <br />
