Adoption of Resolution No. 80-32, setting the Election officer pay and polling place fees as follows: Election Officer Pay Rates Inspector $34~00 per day Judge 30.00 per day Clerk 30.00 per day Inspector Training Class $4..00 per participant Polling Place Fees Without Furniture $20.00 With Furniture 25.00 The roll call vote was as follows: AYES: Councilmen Butler, Mercer, Wood, and Mayor Brandes NOES: None ABSENT: Councilman Kephart SOUTHWEST NUCLEAR COMPANY AGREEMENT Mr. Levine presented a draft agreement relating to the zoning and fire viola- tions of Southwest Nuclear Company located on Commerce Circle in Pleasanton. Mr. Levine advised that the City had met with representatives of Southwest Nuclear Company to discuss the terms of the agreement which would require Southwest Nuclear Company to: (1) eliminate its entire inventory at 7055A Commerce Circle and cease use of that site as soon as possible, but in any case not more than 30 days from the date of this agreement; (2) to eliminate its inventory at 7066A Commerce Circle in excess of the permitted 1500 to 2000 cubic feet, or the equivalent of one 40-foot trailer van load, immediately but in no case more than30 days from the date of this agreement; (3) Company will not bring any additional materials onto either site until the use of 7055A Commerce Circle has been completely eliminated and the inventory at 7066A Commerce Circle has been reduced to the amount specified in its Fire Department permit; (4) Company agrees to cooperate fully with the City of Pleasanton in permit- ting a monitoring program to insure compliance with this agreement and the existing zoning and fire permits; (5) should Company be found to be in violation of any of its City permits or of any agreement made herein, Company by and through its corpor- ate officers, acknowledges and accedes to the revocation of its zoning permit and fire permit and agrees to vacate its facility at 7066A Commerce Circle within a reasonable time thereafter, but not to exceed 60 days; and that the City agrees not to file criminal or civil abatement actions against Company for its existing viola- tions at 7055A and 7066A Commerce Circle so long as Company moves expeditiously to correct said actions and complies in all matters with this agreement. Mr. Levine stated that Southwest Nuclear Company concurred to the terms of the agreement with the exception of the 30 day period for compliance; Southwest Nuclear Company requested this period be for 45 days. Mr. William Hir~' Attorney representing Southwest Nuclear Company, stated that negotiations were underway with the State of Washington for use of the dump site there and the extension of the compliance period would allow completion of this contrac~ aed allow Southwest Nuclear to bring their firm into compliance with City regulations. He stated that Southwest Nuclear Company is in compliance with State radiation regulations and that there.is no danger to the health, saferye. and wel- fare of the operation of this firm. 2. 2/11/80
