Councilmember Kephart stated he and Mayor Brandes had visited the shop in ques- <br />tion in Mission Plaza and that a screened off area was now provided butthat para- <br />phernalia was still visable from the record section. He stated he felt that this <br />ordinance might be circumvented by such an enclosure. <br /> <br /> After discussion, it was moved by Councilmember Kephart, and seconded by <br />Councilmember Mercer, that Ordinance No. 922, to be read by title only and waiving <br />further reading thereof, amending the Ordinance Code of the City of Pleasanton by <br />adding Chapter 8, Title IV, to require business proprietors to exclude minors from <br />any room or place where devices, contrivances, instruments or paraphernalia used, <br />altered or modified for the purpose of smoking, in~ecting or consuming mariJuana, <br />hashish, PCP, or any controlled substance is displayed or offered for sale, and <br />omitting the words "cigarette papers" from the ordinance, and adding "totally <br />opaque" enclosure, be re-introduced. <br />The roll call vote was as follows: <br />AYES: Councilmen Butler, Kephart, Mercer, Wood, and Mayor Brandes <br />NOES: None <br />ABSENT: None <br /> <br /> It was moved by Councilmember Kephart, and seconded by Mayor Brandes, instructing <br />the City Attorney to research an ordinance to ban the sale of all drug paraphernalia <br />within the City of Pleasanton. <br />The roll call vote was as follows: <br />AYES: Councilmen Butler, Kephart, Mercer, Wood, and Mayor Brandes <br />NOES: None <br />ABSENT: None <br /> <br /> The City Attorney advised he would have the report ready for Council considera- <br />tion at the first meeting in February. <br /> <br /> It was moved by Councilmember Kephart, and seconded by Councilmember Mercer, <br />that the City direct its representatives to petition the State Legislature to adopt <br />enabling legislation permitting cities to regulate in the area of drug paraphernalia <br />and display. <br />The roll call vote was as follows: <br />AYES: Councilmen Butler, Kephart, Mercer, Wood, and Mayor Brandes <br />NOES: None <br />ABSENT: None <br /> <br />COMMUNICATIONS <br /> There were no Communications presented at this meeting. <br /> <br />CITY COUNCIL CALENDAR <br /> Mr. Brown presented the Calendar for the information of the Council. <br /> <br /> Mr. Brown stated the RAPmeetings are scheduled for January 14 and January 15, <br />1980, 7:30 P.M., in the Fairgrounds Cafeteria. <br /> <br />EXECUTIVE SESSION <br /> Mayor Brandes recessed the meeting at 11:20 P.M., to an Executive Session to <br />discuss personnel. <br /> <br /> Mayor Brandes reconvened the meeting at 11:55 P.M. <br /> <br /> 14. l/s/8o <br /> <br /> <br />
