The roll call vote was as follows: <br />AYES: Councilmembers Butler, Kephart, Mohr, Wood, and Mayor Mercer <br />NOES: None <br />ABSENT: None <br /> <br /> Councilmember Wood suggested that another condition be added requiring the <br />developer to clean up the site as soon as possible. <br /> <br /> It was moved by Councilmember Butler, and seconded by Councilmember Kephart, <br />that Ordinance No. 967, to be read by title only and waiving further reading thereof, <br />approving the application of Michael Harris for rezoning of the approximately one <br />acre site located near the intersection of Santa Rita Road and West Las Positas <br />Boulevard, just north of Fire Station No. 3 from the RM-25 (Multi-Family Residential) <br />District to the PUD (Planned Unit Development-High Density Residential) District, and <br />for development plan approval for a 16-unit to~nhouse residential development on the <br />site, subject to conditions established by the Planning Commission and adding another <br />condition requiring the developer to clean up the site as soon as possible, be intro- <br />duced. <br />The roll call vote was as follows: <br />AYES: Councilmembers Butler, Kephart, Mohr, wood, and Mayor Mercer <br />NOES: None <br />ABSENT: None <br /> <br />Application of Jack and James Lave7 to rezone the approximately 10,000 sq...ft. site <br />containing. an existing commercial structure and located at 4183 First Street from <br />the C-S (Commercial Service) District to the C-C (Central Commercial) Dis'~ic~'or' <br />to. any other zoninM district consistent with the General Plan <br /> <br />On the basis of an Initial Study of the. potential environmenta~ impacts of th~ <br />p.roject,..the Direc~Or of Pl~nninM and Comm.unityDevelopmept has determined that <br />the proposed project would not have any potential significant adverse effects on <br />the environment and that an environmental impact.. report need not be prepared. Comments on this decision may be directed to either the PlanninM staff <br />prior to the above meeting .date~ or direc~l7 .t.O the City council at the above <br />noticed meetin~ <br /> Mr. Harris presented his report'(SR 81:68) dated March 3, 1981, regardkngI'6his <br />matter. <br /> <br /> Mayor Mercer declared the public hearing open on the application and the Negative <br />Declaration. <br /> <br /> James Lavey, applicant, stated he and his brother wanted to open a mortgage <br />company and operate out of their own building. He advised that Planning Commission <br />had approved the application. <br /> <br /> No one in the audience spoke in opposition to this item. <br /> <br /> There being no further testimony, Mayor Mercer closed the public hearing on ~he <br />application and the Negative Declaration. <br /> <br /> It was moved by Councilmember Wood, and seconded by Councilmember Mohr, that <br />Resolution No. 81-65, determining on the basis of a review of initial environmental <br />study done for this project, that no significant environmental impact would occur <br /> Cit ' <br />as outlined in the y s guidelines and that a Negative Declaration is appropriate <br />to rezone the approximately 10,000 sq. ft. site containing an existing commercial <br />structure and located at 4183 First Street from the C-S (Commercial Service) Dis- <br />trict to the 'C-C (Central Commercial) District, be adopted. <br /> <br /> 5. 3/10/81 <br /> <br /> <br />
