It was moved by Mayor Mercer, and seconded by C0uncilmember Butler, that Resolu- <br /> tion No. 81-42, approving two amendments to the Sewer Service Contract as follows: <br /> (1) Section 4.01 be amended so that the Fixed Cost Allocation for each member shall <br /> be as follows: Livermore-49.62%, Pleasanton-28.71%, and D.S.R.S.D.-21.67%; and (2) <br /> Section 3.03 be amended so that the maximum sewer service required to be provided to <br /> each member shall be as follows: Livermore-7.02 mgd (Actual Flow 8.424), Pleasanton- <br /> 5.63 mgd (Actual Flow 6.756), and D.S.R.S.D.-3.97 mgd (Actual Flow 4.764), be adopted. <br /> The roll call vote was as follows: <br /> AYES: Councilmembers Butler, Kephart, Mohr, Wood, and Mayor Mercer <br /> NOES: None <br /> ABSENT: None <br /> <br /> REPORTS OF THE CITY ATTORNEY <br /> Review of Possible Alternatives for the Residential Allocation Program and Propos~l <br /> for Committee to Study those chan~es <br /> The City Attorney advised that his report regarding this matter was not yet <br /> completed and would be incorporated in the report regarding the abolishment of the <br /> Residential Allocation Program requested by Council tonight under Matters Initiated <br /> by Councilmembers, to be reviewed on March 10, 1981. <br /> <br /> Amendment to Noise Ordinance <br /> Mr. Levine presented his report (SR 81:39) dated February 4, 1981, regarding <br /> this matter. <br /> <br /> It was moved by Councilmember Butler, and seconded by Councilmember Wood, that <br />Ordinance No. 964, to be read by title only and waiving further reading thereof, <br />amending Section 4-9.02(b) of Chapter 9, Title IV, of the Noise Ordinance relative <br />to the definition of the sound level meter, be introduced. <br />The roll call vote was as follows: <br />AYES: Councilmembers Butler, Kephart, Mohr, Wood, and Mayor Mercer <br />NOES: None <br />ABSENT: None <br /> <br />COMMUNICATIONS <br /> There were no Communications presented at this meeting. <br /> <br />CITY COUNCIL CALENDAR <br /> Mr. Walker presented the Calendar for the information of the Council. <br /> <br />EXECUTIVE SESSION <br /> Mayor Mercer recessed the meeting at 12:45 A.M., to an Executive Session to <br />discuss pending litigation. <br /> <br /> Mayor Mercer reconvened the meeting at 12:55 A.M. <br /> <br />ADJOURNMENT <br /> There being no further business at 1:00 A.M., it was moved by Councilmember <br />Kephart, and seconded by Councilmember Mohr, that the meeting be adjourned to meet <br />again in Regular Session on February 24, 1981, 8:00 P.M., Fairgrounds Cafeteria. <br />The roll call vote was as follows: <br />AYES: Councilmembers Butler, Kephart, Mohr, Wood, and Mayor Mercer <br />NOES: None <br />ABSENT: None <br /> <br /> 20. 2/lO/Sl <br /> <br /> <br />
