Appeal from the decision of the Police Chief re~ardin~ card room permit application <br />made by Wallace F. Travasso for 537 Main Street~ Pleasanton <br /> Mr. Levine presented his report (SR 81:23) dated January 22, 1981, regarding this <br />matter. <br /> <br /> Mayor Mercer declared the public hearing open on this item. <br /> <br /> Mr. Preston Hill, 2 North Second Street, San Jose, Attorney representing Mr. <br />Travasso, stated that he understood that there had been health and safety problems <br />regarding Mr. Travasso's operations. But Mr. Travasso had obtained a card room <br />license permit and was not aware that he was responsible for renewing the permit <br />at the end of the one year period. He stated that no notice had been sent by the <br />City advising him that his card room license should be renewed annually. He stated <br />that during recent problems involving health and safety laws, the card room license <br />had expired but that Mr. Travasso had recently applied for a renewal. Mr. Hill <br />stated that the license requires that the Chief of Police approve the license with- <br />in five days, and that the license must be granted unless the Police Chief finds <br />some reason not to. He stated that the City Council had Just adopted an amendment <br />to the card room ordinance on an urgency basis and he did not feel this was fair to <br />Mr. Travasso. Mr. Hill stated that regardless of the intent, the new ordinance <br />appears to keep Mr. Travasso from continuing his business, rather than the ordi- <br />nance generally addressing the problems inherent to this type of business. Mr. Hill <br />also stated that the other problem is whether Mr. Travasso's permit will be treated <br />by those who determine such matters as being still in effect. Mr. Hill suggested <br />that maybe the present card room ordinance could be revised or a set of administra- <br />tive procedures established to help control certain aspects of governing businesses <br />not covered by ordinary laws. He requested Council to arrive at a decision lawfully <br />to allow Mr. Travasso to continue his business with controls to avoid future problems. <br /> <br /> Councilmember Kephart asked Mr. Hill if it was his position that the City of <br />Pleasanton should contact people to tell them to renew their licenses. Mr. Hill <br />replied that notification is important. Councilmember Kephart then asked Mr. Hill <br />if it was his position that the City of Pleasanton is obligated to notify Mr. Tra- <br />vasso to renew his license. Mr. Hill replied Yes. Councilmember Kephart stated he <br />did not agree, and also took exception to the comments made relative to keeping Mr. <br />Travasso from doing business, and further stated the City does not have to notify <br />anyone to renew their permits. <br /> <br /> Mr. Wallace J. Travasso stated that at the time he took over the Castle Bar he <br />was unaware that he had to renew his card room license, assuming that he would be <br />notified by the City when it was time for renewal. <br /> <br /> No one in the audience spoke in opposition to this matter. <br /> <br /> There being no further testimony, Mayor Mercer declared the public hearing <br />closed on this item. <br /> <br /> After discussion, Mayor Mercer declared the decision of the appeal from the <br />decision of the Police Chief regarding card room permit appllcationmade by Wallace <br />F.
