Mayor <br />Mercer instructed the reports be noted and filed. <br /> <br />REPORTS OF THE CITY ATTORNEY <br />Denial of Cla/m~ John and JoTce Salo <br /> Mr. Levine presented his report (SR 81:01) dated January 2, 1981, regarding this <br />matter. <br /> <br /> It was moved by Councilmember Wood, and seconded by Councilmember Mohr, that <br />Resolution No. 81-9, denying the claim of John and Joyce Salo, be adopted. <br />The roll call vote was as follows: <br />AYES: Councilmembers Kephart, Mohr, Wood, and Mayor Mercer <br />NOES: None <br />ABSENT: Councilmember Butler <br /> <br />Denial of Claim of Matusek <br /> Mr. Levine presented his report (SR81:07) dated January 7, 1981, regarding this <br />matter. <br /> <br /> It was moved by Councilmember Kephart, and seconded by Councilmember Wood, that <br />Resolution No. 81-10, denying the claim of Ronald and Janet Matusek, be adopted. <br />The roll call vote was as follows: <br />AYES: Councilmembers Kephart, Mohr, Wood, and Mayor Mercer <br />NOES: None <br />ABSENT: Councilmember Butler <br /> <br />Matters for the Information of the Council <br /> Mr. Levine presented his Information Report 81:02 dated January 2, 1981, regarding <br />Drug Paraphernalia Litigation, stating that the Fourth District Court of Appeals of <br />the State of California has decided the case of Music Plus Four, Inc., etc., vs.. <br />Robert Barnet, etc., et al., the first of the drug paraphernalia cases to reach an <br />appellate court, and the opinion written by Justice Morris finds the drug paraphernalia <br />ordinance of the City of Westminster to be valid and free from the constitutional de- <br />fects claimed by the owners of a drug paraphernalia emporium. Mr. Levine advised that <br />Pleasanton is one of twenty Jurisdictions that Joined in support of the City of West- <br />minster as an amicus curiae. <br /> <br /> Mr. Levine presented his Information Report 81:04 dated January 8, 1981, regard- <br />ing Bownds v. City of Glendate, stating that the decision issued from the Court of <br />Appeals, Second Appellate District, upholds the position of the amicus curiae, of <br />which the City of Pleasanton was one, that the housing element guidelines issued by <br />the Department of'Housing and Community Development are advisory only and HCD has no <br />authority on its own to compel compliance with those guidelines. Mr. Levine advised <br />that this issue produced not only litigation, but also legislative debate and action. <br /> <br /> Mayor Mercer instructed these reports be noted and filed without any further <br />Council action. <br /> <br />COMMUNICATIONS <br /> There were no Communications presented. at this meeting. <br /> <br />CITY COUNCIL CALENDAR <br /> Mr. Walker presented the Calendar for the information of the Council. <br /> <br /> 8. 1/13/Sl <br /> <br /> <br />
