Matters for the Information of the Council <br /> Mayor Mercer presented the Information Report of the Director of Planning and <br />Community Development (IR 81:39) dated December 17, 1981, relative to notification <br />procedures regarding planning matters. After discussion, Council instructed staff <br />to notify every property owner within 300 feet of all annexation proceedings at the <br />time of formal resolution. <br /> <br />REPORTS OF THE CITY ATTORNEY <br />Approval of Lee Sammis Contract <br /> Mr. Levine presented his report (SR 81:454) dated December 17, 1981, regarding <br />this matter. He reviewed the two clauses that he recommended for addition relating <br />to the equal treatment clause and previous agreements, for added protection of the <br />City. <br /> <br /> Mr. Anthony Varni, representing Lee Sammis, stated this group is being asked to <br />enter into an agreement in the Assessment District, and are committed to it no matter <br />who else is in it. The way the Assessment District is set up they could be the only <br />property in Zone A and would be required to pay for the entire freeway improvements. <br />He asked City Council for assurance that other properties in the Stoneridge Center <br />be included. Mr. Varni stated that it is difficult to determine at this time what <br />will be improved and what will be unimproved in the future in the commercial area. <br />He stated he felt all properties should be treated the same and the spread in the <br />Assessment District be made equal. He stated his client's property is only 11 acres <br />and needs protection. Mr. Varni requested the Minutes reflect the following: (1) <br />that all Councilmen present support the concept of a fair and equitable spread of the <br />assessment on all undeveloped office and commercial properties in the area of the <br />Stoneridge Center; and (2) that the Council by refusing to add the language requested <br />by Sammis with regard to "Equal Treatment" was following the recommendation of the <br />City Attorney and did not intend to indicate that there would be unequal treatment of <br />undeveloped office and commercial properties in the spread of the assessment for the <br />Stoneridge Center. Council concurred. <br /> <br /> After further discussion, it was moved by Councilmember Butler, and seconded by <br />Councilmember Mohr, that Resolution No. 81-443, approving the Mitigation Measures <br />Agreement between the City of Pleasanton and Lee Sammis Company, including additional <br />clause relating to previous agreements, be adopted. <br />The roll call vote was as follows: <br />AYES: Councilmembers Butler, Mohr, Wood, and Mayor Mercer <br />NOES: None <br />ABSENT: Councilmember Kephart <br /> <br />Mitigation Measures Agreement for Farmers Insurance Company <br /> Mr. Levine presented the Mitigation Measures Agreement with Farmers Insurance <br />Company for water and fire mitigating measures. <br /> <br /> It was moved by Councilmember Butler, and seconded by Councilmember Mohr, that <br />Resolution No. 81-444, approving the Mitigation Measures Agreement for water and <br />fire, between the City of Pleasanton and Farmers Insurance Company, as submitted <br />by the City Attorney, be adopted. <br />The roll call vote was as follows: <br />AYES: Councilmembers Butler, Mohr, Wood, and Mayor Mercer <br />NOES: None <br />ABSENT: Councilmember Kephart <br /> <br />Pending Liti~ation - SB 314 and SB 999 <br /> Mr. Levine presented his report (SR 81:457) dated December 21, 1981, regarding <br />this matter. <br /> <br /> It was moved by Councilmember Butler, and seconded by Councilmember Wood, that <br />the City Attorney be directed to contact the appropriate legislators indicating <br />Council's opposition to SB 314 (Dills) - offering the opportunity to force the issue <br />of compulsory and binding arbitration to an election in general law cities; and <br />opposition to SB 999 (Campbell) - prohibiting local government from banning the sale <br />of fireworks through existing zoning laws. <br /> <br /> 14. 12/22/81 <br /> <br /> <br />
