109 <br /> <br /> The roll call vote was as follows: <br /> AYES: Councilmembers Brandes, Mercer, Mohr, Wood, and Mayor Butler <br /> NOES: None <br /> ABSENT: None <br /> <br /> After discussion, it was moved by Councilmember Brandes, and seconded by Council- <br /> member Mercer, that Ordinance No. 1040, to be read by title only and waiving further <br /> reading thereof, approving the application of Prudential Insurance Company of America <br /> and Callahan-Pentz Properties for Planned Unit Development-Industrial/Commercial and <br /> Offices zoning and development plan approval of a 573 acre "business park" to be <br /> located on the east side of Hopyard Road between the Arroyo Mocho and a point approxi- <br /> mately 1400 feet south of 1-580 and extending east to the tracks of the Southern <br /> Pacific Transportation Company, subject to conditions contained in Planning Commis- <br /> sion Resolution No. 2174 except as modified below: <br /> <br /> modify Condition 1 to insert "except mid-rise office" between the words <br /> "office" and "research" in line 7; <br />~ amend Condition 2 as follows: <br />'D <br />~ a. add to the list of intersections excepted from Table 5 of the North <br />~ Pleasanton Traffic Study Volume 3, Dougherty Road/Dublin Boulevard, <br /> b. add a final paragraph to condition number 2 as follows: "With regard <br /> to the Hopyard Road/I-580 westbound off-ramp, development of the <br /> Hacienda Business Park may commence once the developers have bonded <br /> for those improvements deemed necessary a~d acceptable to Caltrans <br /> and the City Engineer of the City of Pleasanton to reduce that inter- <br /> section from its current level of service E to LOS D or better, and <br /> that these improvements shall be constructed as soon as possible"; <br /> <br /> add a new condition (Condition No. 108) as follows: <br /> <br /> 108. That the developer and the City of Pleasanton shall enter into an agree- <br /> ment relating to possible claims against the City for inverse condemna- <br /> tion, assessment district relief, or any other claim seeking to require <br /> the City's approval for development or seeking an assessment district <br /> or other refund in contravention of these PUD conditions. Such agreement <br /> shall be recorded contemporaneously with the subdivision map for the <br /> property; <br /> <br /> and clarify that all parcels being developed must be considered by the Planning <br /> Commission and City Council for approval, be introduced. <br /> <br /> Councilmember Brandes further added that the Council find that this application <br /> should be approved despite its adverse environmental effects because of the over- <br /> riding social, economic and environmental considerations, these are provision of local <br /> Jobs, improvement of the circulation system in the north Pleasanton area, and increase <br /> in the tax base of the community disproportionate to the demands placed upon City <br /> services by the development itself, alleviation of flood hazards to urbanized areas, <br /> reduction in noise levels in residential areas, and other factors as discussed in <br /> staff reports and the hearings on the project. Mayor Butler added that the project <br /> was consistent with the General Plan and Planned Unit Development Ordinance, that <br /> this action was but the first step in a long process, and that the project's approval <br /> was consistent with the balanced community concept given the time span involved and <br /> the adjustments which were certain to be made in the next 25 years. <br /> <br /> 16. 6/8/82 <br /> <br /> <br />
