387 <br /> <br />ative vote of property owners owning 50% of the assessed value within the proposed <br />district; and, it is up to the Council to determine who to put in an assessment <br />district. <br /> <br /> There being no further testimony, Mayor Butler declared the public hearing <br />closed on this item. <br /> <br /> After discussion, it was moved by Councilmember Brandes, and seconded by Council- <br />member Wood, that the following findings could be made in this instance: (1) that <br />because there are special circumstances having to do with the efficient utilization <br />of the subject property, the strict application of the provisions of the Code would <br />deprive the property owner of privileges enjoyed by other properties in the vicinity <br />and under identical zoning classification; (2) that because of the special circumstances <br />mentioned in paragraph (1) above, the granting of the variance will not constitute a <br />grant of special privilege inconsistent with the limitation on other properties clas- <br />sified in the same zoning district; (3) that the granting of the variance will not be <br />detrimental to the public health, safety, or welfare, or materially injurious to pro- <br />perties or improvements in the vicinity; (4) that neither present nor anticipated <br />future traffic volumes generated by the use of the site or the uses of sites in the <br />vicinity reasonably require strict or literal interpretation and enforcement of the <br />specified regulation; (5) that the granting of the variance will not result in the <br />parking or loading of vehicles on public streets in such a manner as to interfere with <br />the free flow of traffic on the streets; and (6) that the granting of the variance will <br />not create a safety hazard or any other condition inconsistent with the objectives of <br />this chapter, - and that Resolution No. 82-165, approving the appeal of Wanda Aldrich <br />to Condition No. 2 imposed by the Board of Adjustment in their approval to allow con- <br />tinued operation of a beauty shop which was enlarged at 541 Main Street without pro- <br />viding the required off-street parking spaces and granting the variance without the <br />assessment district requirement condition, be adopted. <br />The roll call vote was as follows: <br />AYES: Councilmembers Brandes, Mercer, Mohr, Wood, and Mayor Butler <br />NOES: None <br />ABSENT: None <br /> <br />Application of the City of Pleasanton to rezone approximately 8.8 acres of land (4323 <br />and 4365 Va~lel Avenue) located on the north side of Valley Avenue adjacent and to the <br />west of the Valle~ Plaza Shoppin~ Center from the "A" (ASric.u!tural) and R-1-6500 <br />(Single-family Residential) Districts to the PUD (Planned Unit Development) HiSh Den- <br />sity Residential District or to any other zoning district consistent with the General <br />Plan <br /> <br />On the basis of an Initial Study of the potential environmental impacts of the pro- <br />ject, the Director of Planning and Community Development has determined that the pro- <br />posed projec.t.._would not have any potential significant adverse effects on the environ- <br />ment and that an environmental impact report need not be pr.epared. This Initial Study <br />is available for review at the Planning Division, 200 Bernal Avenue, Pleasanton.
