493 <br /> <br /> After discussion, it was moved by Councilmember Butler, and seconded by Mayor <br /> Mercer, that the City Council of the City of Pleasanton ranks the alternative methods <br /> of organizing to provide wastewater treatment and disposal capacity for the Valley, <br /> as described in the Sewer Committee report, in the following order: <br /> <br /> No. 1 - Alternative No. 2; Existing LAVWMA to provide export services; <br /> <br /> No. 2 - Alternative No. 3; Modified LAVWMA to include existing and additional <br /> agencies to provide export services; <br /> <br /> and that no further ranking of the other alternatives was deemed necessary at <br /> this time. <br /> The roll call vote was as follows: <br /> AYES: Councilmembers Butler, Kephart, Mohr, Wood, and Mayor Mercer <br /> NOES: None <br /> ABSENT: None <br /> <br /> MEETING OPEN TO THE PUBLIC <br /> No one in the audience addressed the chair. <br /> <br /> PUBLIC HEARINGS <br /> Application of Richard and Ursula Ultsch and Theodore Bates for prezoning and <br /> development plan approval for an approximately 247 dwelling unit project on an <br /> approximately 29 acre site located at the north side of Vineyard Avenue opposite <br /> Sauterne Way. The property is currently prezoned P.U.D. (Planned Unit Develop- <br /> ment) Medium Density Residential District with certain conditions governing its <br /> development. The City Council maX recommend approval of the new prezon~ng and <br /> the proposed development plan or ma_ke any other recommendations regarding the <br /> subject property consistent with the General Plan <br /> <br />On the basis of an Initial Study of the potential environmental impacts of the <br />projects. the Director of Planning and Community Development has determined that <br />the proposed project would not have any potential significant adverse effects on <br />the environment and that an environmental impact report need not be prepared. <br />This Initial Study is available for review at the Planning Division, 200 Bernal <br />Avenue~ Pleasanton. Comments on this decision may be directed to either the <br />Planning staff. prior to the above meeting date, or directly to the City Council <br />at the above noticed meeting <br /> Mr. Harris presented his report (SR 82.133) dated April 1, 1982, regarding this <br />matter. <br /> <br /> Mayor Mercer declared the public hearing open on the application and the nega- <br />tive declaration. <br /> <br /> Mr. William Hirst, 147 Bernal Avenue, Attorney representing the applicants, <br />stated his client is here tonight to present a revised plan for the proposed pro- <br />ject that hopefully will meet the concerns of Councilmembers and the residents in <br />the area. He stated he has reviewed the staff report and the 38 conditions con- <br />tatned therein, and agrees to the conditions with the exception of four. Condition <br />No. 9, if approved, would require the applicant to install the front yard land- <br />scaping. Mr. Hirst stated this issue had been discussed previously and it seemed <br />to be more appropriate to make this optional, allowing the homeowner to install his <br />own landscaping. He advised that the CC&R's would strictly control the timing and <br />type of landscaping allowed. Mr. Hirst stated that since the streets now proposed <br />will be the same as any other public streets, he felt they should be declared as <br />public streets and that Conditions 33, 37, and 38 could be eliminated.
