103 <br /> <br /> Mr. Harris reviewed the changes made to the plan since the one that was origi- <br /> nally approved; the major changes being the increased size of the free-standing <br /> office building and deletion of building "C" (combining to slightly increase the <br /> total floor area), and the addition of parking spaces. He stated that all condi- <br /> tions of approval on the previously approved design review are essentially the same <br /> except for the addition of the three North Pleasanton assessment conditions. He <br /> stated the developer indicated the free-standing building will be constructed first <br /> with no plans for ~mmediate construction of the remaining buildings. <br /> <br /> Mayor Mercer asked if the application could be conditioned to require the <br /> developer to build the commercial portion of the project before the office build- <br /> ing. The City Attorney advised this could be done. <br /> <br /> It was moved by Councilmember Butler, and seconded by Councilmember Mohr, that <br /> Resolution No. 82-105, determining on the basis of a review of initial environmental <br /> study done for this project, that no significant environmental impact would occur as <br /> outlined in the City's guidelines and that a negative declaration is appropriate for <br /> P.U.D. (Planned Unit Development) zoning and development plan approval for a commer- <br />~ cial and office project consisting of five structures totalling approximately 88,000 <br />~ sq. ft. on an approximately eight acre site located at the southeast corner of West <br />CO Las Positas Boulevard and Santa Rita Road, be adopted. <br />~ The roll call vote was as follows: <br /> AYES: Councilmembers Butler, Kephart, Mohr, and Mayor Mercer <br />~ NOES: None <br />~ ABSENT: Councilmember Wood <br /> <br /> Councilmember Mohr stated that the purpose of the office building is to house <br /> the applicant's o~n office and for banking purposes. She stated she felt this would <br /> be a plus for the neighborhood. She stated she felt the application should not be <br /> conditioned to construct the commercial portion first as it might prevent the pro- <br /> ject from being constructed. <br /> <br /> Councilmember Butler stated this is one of the several areas where shopping is <br /> needed. He stated he felt it is important that the project get started then allow <br /> the commercial portion of the development to come along as quickly as possible. <br /> <br /> Mayor Mercer stated that the Vintage Hills project was conditioned upon building <br /> the commercial portion of the project before the residential portion could be ~tarted. <br /> <br /> Mr. Glenn Kierstead, Meadow Plaza Associates, 2836 Sombrero Circle, San Ramon, <br /> entered the meeting at this time (9:10 p.m.). He stated the reason for requesting <br /> P.U.D. zoning is so that the project can be done in phases, because of the diffi- <br /> culty in obtaining financing. He stated with the absence of take-out loans, syndi- <br /> cation would be used. He stated he would like to construct the office building first <br /> to house his headquarters. He stated that Save-Mart still plans to become a tenant. <br /> He added that the office building is the key to this project being constructed. He <br /> asked for PUD zoning to accommodate the syndication method of financing, stating he <br /> would like to start Phase I in June and begin the market portion the following spring. <br /> He stated that if tenants are secured he will construct the other buildings simul- <br /> taneously. Mr. Kierstead stated the only conditions he is opposed to are the three <br /> assessment district conditions. He felt these conditions put him in the assessment <br /> district without going through the process already set up in the assessment district <br /> for protests. He advised the preliminary assessment district fees on this particular <br /> acreage are about 70% of the land value in 1980 and he felt this is too much to bear. <br /> <br /> 10. 3/23/82 <br /> <br /> <br />
