235 <br /> <br /> Mr. Ed Parish, 2499 Westgate Avenue, San Jose, presented revised parking plans <br />which increased the parking by 36 mid-block spaces and 24 spaces at the north end. <br />He stated the units lost to parking could be relocated to the eastern tiers to be- <br />come all duplexes and create a senior citizens area with barbeques also provided. <br />He proposed that the homeowners association provide for a project manager four hours <br />per day. Landscaping would be required to be in place within 90 days of occupancy <br />or the homeowners association would landscape the lot. He also proposed that the <br />City be reimbursed for any Police Department expenses incurred relating to parking <br />enforcement that is not handled by the homeowners association. <br /> <br /> Mayor Mercer stated he could not vote in favor of the project because the streets <br />are only 25 feet wide and this would not be adequate for traffic flow of the project <br />as well as emergency vehicles. <br /> <br /> After discussion, it was moved by Councilmember Kephart, and seconded by Council- <br />member Mohr, that Resolution No. 82-53, approving Case PUD-81-34, application of <br />Richard and Ursula Ultsch and Theodore Bates for prezoning and development plan <br />approval for a 252 dwelling unit project on an approximately 29 acre site located on <br />the north side of Vineyard Avenue opposite Sauterne Way, subject to conditions set <br />forth in Planning Commission Resolution No. 2119, but deleting Condition No. 7 - <br />that front yard landscaping including sprinkler system, for all units shall be pro- <br />vided by developer, and adding the following conditions: (1) that two large trees be <br />planted by the developer at the front yard of each unit; (2) that a portion of the <br />project be reserved for senior citizens, 50 years old and over; (3) that 36 additional <br />mid-block parking spaces be made available on four lots; (4) that 24 parking spaces be <br />made available at the north end of the project; (5) that the CC&R's be worded to in- <br />clude the hiring of a project manager for a minimum of four hours per day; (6) that <br />landscaping be done by the homeowners and be accomplished within 90 days after occu- <br />pancy; and (7) that back-up parking enforcement will be provided for by the Police <br />Department at the cost of the homeowners association, be adopted. <br />The roll call vote was as follows: <br />AYES: Councilmembers Kephart and Mohr <br />NOES: Councilmembers Butler, Wood, and Mayor Mercer <br />ABSENT: None <br /> <br />SPECIAL REPORTS <br /> There were no Special Reports presented at this meeting. <br /> <br />REPORTS OF BOARDS AND COMMISSIONS <br />Recommendations from the Plannin~ Commission regarding vacant I-G (General Industrial) <br />zoned land east of 1-680 <br /> Mayor Mercer declared this item continued to the meeting of February 23, 1982, at <br />the request of a property owner. <br /> <br />Actions Taken by the Board of Adjustment~ Design Review Board~ and Planning Commis- <br />sion at their meetin~ of 1-27-82 <br /> Mr. Harris presented his report (SR 82:40) dated January 29, 1982, regarding <br />this matter for the information of the Council.
