211 <br /> <br />REPORTS OF THE CITYMANAGER <br />Report. on proposed Annexation of the Schwerin Property (176 Acres on Dublin Canyon <br />Road <br /> (Contd. from 1-12-82) <br /> Mr. Warnick presented his report (SR 82:36) dated January 21, 1982, regarding <br />this matter. <br /> <br /> Mr. Dick Karn, of Bissell and Karn, representing the applicant, stated he con- <br />curs with staff recommendations. <br /> <br /> Councilmember Mohr stated she felt this proposed annexation would leave the City <br />with a very pecular boundary line. Councilmember Wood stated the City limit lines <br />look like "scrabble". <br /> <br /> After discussion, it was moved by Councilmember Butler, and seconded by Mayor' <br />Mercer, instructing staff to prepare a formal resolution requesting the annexation <br />and an application to LAFCO for approximately 176 acres on Dublin Canyon Road owned <br />by Robert Schwerin and Woody Ersted, and for property lying adjacent and to the <br />south (Assessor's Parcel 941-1800-1-2)along Foothill Road westerly to the Schwerin <br />property, and requiring the applicant to either have an acceptable legal description <br />and map of the proposed annexation (meeting LAFCO standards) prepared by a licensed <br />civil engineer or land surveyor, or pay a fee determined by the City Engineer to <br />cover the costs of preparation of the description and map by the City, and supply <br />to the City a recent title report for the proposed annexation along with all adja- <br />cent deeds, the method of preparation to be determined by the City Engineer. <br />The roll call vote was as follows: <br />AYES: Councilmembers Butler, Mohr, and Mayor Mercer <br />NOES: Councilmember Wood <br />ABSENT: Councilmember Kephart <br /> <br />Extension of R.A.P. Approved Projects <br /> Mr. Walker presented his report (SR 82:30) dated January 20, 1982, regarding <br />this matter. <br /> <br /> Mr. Ted Fairfield, Civil Engineer, representing Mackay Homes and several other <br />developers, stated he felt one year extensions should be given for RAP allocations <br />that have already been granted. He stated he realized that extensions could not <br />be extended forever, but due to economic conditions he felt that a one year exten- <br />sion is reasonable, and that no extension should be denied without fair warning to <br />all concerned. Mr. Fairfield questioned the accuracy of the list presented in the <br />staff report. <br /> <br /> Mr. Jeff Thayer, President of Warmington Homes, stated he concurred with Mr. <br />Fairfield. He advised his development could not go forward because of economics, <br />that improvements are already in the ground, that his firm had previously competed <br />for RAP allocation, and to not extend the permits at this time would be devastating <br />to his company. He strongly urged that extensions be granted at this time. <br /> <br /> Mr. Fairfield advised that Mackay Homes also has all of their engineering com- <br />pleted and the final maps are ready to be recorded. He stated that if approval of <br />extensions is not granted now it will take away from the alternative available to <br />the developer. <br /> <br /> Mr. Doyle Heaton, Vintage Hills Associates, stated that some developments have <br />waited ten years to get started and should not be denied now.
