365

j. Adoption of Resolution No. 82-457, approving Seventh Amendment to
Agreement between City of Pleasanton and Kennedy/Jenks Engineers, Inc.
(overhead cost adjustments).

k. Adoption of Ordinance No. 1060, establishing sewer connection fees
for commercial, industrial, and institutional uses.
Councilmember Mercer voted NO on this item.

1. Adoption of Resolution No. 82-458, denying the claim of Donna Zurla.

m. Adoption of Resolution No. 82-459, accepting deed from Valley Business
Associates and Sente Associates Seven for street dedication and
authorizing quitclaim from the City to above for easement no longer
necessary.

n. Adoption of Resolution No. 82-460, approving claims; review of financial
reports, October, 1982.

o. Adoption of Resolution No. 82-461, approving request to close Main Street
for Christmas Tree Lighting.

The roll call vote was as follows:

AYES: Councilmembers Brandes, Mecer, Mohr, Wood, and Mayor Butler
NOES: None
ABSENT: None

As indicated above, Councilmember Mercer voted NO on item 4K.

MATTERS INITIATED BY COUNCILMEMBERS
Councilmember Mercer presented a brochure which is being circulated
by the Citizens for Balanced Growth group indicating he felt it was inflammatory
and filled with innuendo, falsehoods and does not represent the actual situation.
He then gave his comments rebutting the points raised in the brochure
CBG claims companies will transfer employees, salaries will rise
and the cost of living will follow. Councilmember Mercer indicated this
is going to happen anyway and it would be great for Pleasanton residents to
get a pay raise and also get a job transfer so they can work in town.
CBG claims taxes will rise and Council can levy new taxes or assessment
districts at will. Mercer indicated Prop 13 disallows new taxes and that no
residential property is included in the assessment districts.
CBG claims housing will sprawl from "hillside to hillside" and cause
pressure on schools. Councilmember Mercer indicated residential growth will
remain in accordance with the General Plan and that no double sessions are
planned for Pleasanton schools as suggested.
CBG also pointed out increases in air pollution and higher noise levels,
which Councilmember Mercer strongly rejected indicating the pollutant level
has dramatically improved since opening the new freeway over the hill; Pleasanton
does not produce its own smog since it comes in from Hayward and San Jose areas.
Councilmember indicated that in, the past there have been three elections
dealing with industrial/commercial growth in Pleasanton, and at all three
elections the vote was overwhelmingly in favor of growth. He feels this
small group is not telling the truth and not doing what most residents feel
is proper.

11/23/82
